SUMMARY:
The Probation Department requests approval of the County's Multi-Agency Juvenile Justice Plan Modification for FY 2012-13 and authorization for the Chief Probation Officer to submit the Plan Modification and the Application for Approval of the County's CMJJP Modification to the Corrections Standards Authority.
BACKGROUND INFORMATION:
Assembly Bill 1913 was approved as an urgency statute, effective September 7, 2000. Now known as the Juvenile Justice Crime Prevention Act (JJCPA), AB 1913 added $121.3 million to the County Supplemental Law Enforcement Services Funds to implement a Comprehensive Multi-Agency Juvenile Justice Plan (CMJJP) developed by the local Juvenile Justice Coordinating Council (JJCC) in each county or city and county. The Orange County JJCC developed the CMJJP to fund juvenile justice programs to be administered by the Probation Department. Your Honorable Board approved Orange County's CMJJP on December 19, 2000. The State Board of Corrections (now known as the Corrections Standards Authority - CSA) subsequently approved the Plan on January 11, 2001, thereafter making $9,991,842 available for use in Orange County through June 30, 2002.
Your Honorable Board has subsequently approved the Probation Department's modified plans each year, including the FY 2011-12 plan.
Previous funding for the CMJJP programs came from Vehicle License Fees, as adopted by the State with the passage of the 18 month budget in February 2009. For FY 2012-13, CSA provided a funding estimate of $8,628,581 for Orange County. Under instruction from CSA, for purposes of submitting the CMJJP application, the programs assume continued funding from Vehicle License Fees.
To remain eligible for the funding, annual CMJJP filings or modifications must be reviewed and approved by the Orange County JJCC and Your Honorable Board. For FY 2012-13, the Probation Department seeks your Board's authorization to submit an Application for Continued Funding to the State Corrections Standards Authority.
The JJCC convened on April 5, 2012 and approved the FY 2012-13 JJCPA budget of $8,905,329.

It is anticipated that the programs noted above will cost a total of $8,905,329 for FY 2012-13. The JJCPA programs will be funded with $8,628,581 in State funding and $276,748 in Federal Title IV-E funds.
FINANCIAL IMPACT:
The County's Multi-Agency Juvenile Justice Plan (CMJJP) has been built assuming continued funding at the levels received in the current fiscal year. In the event that the Vehicle License Fee (VLF) revenue is not extended, the Probation Department has developed contingency plans to address the funding shortfall.
