Find that: (i) Final EIR 582 and Addendum 582-1, as revised by Final Supplemental EIR 582, previously certified on June 25, 2002, accepted on December 10, 2002, and certified on October 19, 2004, respectively, have been examined in relation to the proposed project; (ii) the proposed project's environmental effects were fully analyzed and disclosed in these CEQA documents and the proposed project would not have any environmental effects beyond those analyzed and disclosed in these environmental documents; (iii) no further CEQA compliance is required for the proposed project. |

SUMMARY:
Approve Certificated Passenger Airline Lease between the County of Orange and WestJet, an Alberta Partnership
BACKGROUND INFORMATION:
This ASR requests Board approval of a Certificated Passenger Airline Lease (Lease) with WestJet, an Alberta Partnership (WestJet). On January 11, 2011 the Board of Supervisors approved the Phase Two Access Commercial Airline Plan (Plan) for the 2011 plan year. This Plan allocated three (3) Class A ADD's to WestJet who was on the waiting list. WestJet requested a reduction of 1 Class A ADD in their allocation for the plan year and will operate one (1) daily non-stop flight to Vancouver, British Columbia, beginning May 2, 2011, and one (1) daily non-stop flight to Calgary, Alberta, beginning June 13, 2011. WestJet will be operating in Terminal A.
The WestJet Lease has a termination date of December 31, 2011 due to ongoing Lease negotiations with airlines currently serving JWA. WestJet will be issued a new lease with a termination date that will correspond to all airline Leases once negotiations between the County and the airlines are completed.
CEQA COMPLIANCE:
Final EIR 582, Addendum 582-1 and Final Supplemental EIR 582 previously certified on June 25, 2002, accepted on December 10, 2002, and certified on October 19, 2004, respectively, have been prepared for the Settlement Agreement Amendment and Settlement Amendment Implementation Plan ("proposed project"). The Board is required to examine the subject project to determine whether its environmental effects were fully analyzed and disclosed in these previous CEQA documents and whether the subject project would have any environmental effects beyond those analyzed and disclosed in the previous environmental documents. If the Board concurs, no further CEQA compliance is required as noted in Recommended Action #1.
FINANCIAL IMPACT:
The amount paid to the County for WestJet's lease period of May 2, 2011 through December 31, 2011 will be approximately $838,552.
