RECOMMENDED ACTION(S):

 

 

1.

Find that the proposed project is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to review under CEQA.

 

2.

Approve and execute the Quitclaim Deed authorizing the conveyance of the Midway Meadows Property to Midway Interests, L.P.

 

 

 

 

SUMMARY:

 

Approval of the Quitclaim Deed will facilitate the conveyance of the property to Midway Interests, L.P. in accordance with Lease terms.

 

 

 

BACKGROUND INFORMATION:

 

On November 5, 1985, the County of Orange (County) granted a Lease to Shawntana Interests I, a California General Partnership (“Shawntana”), for the development of an affordable senior housing project on County-owned property located at 14542-14852 Park Lane, Midway City. The Lease provides for a 30-year term and requires that the property be used for the development of 92 affordable rental units. Lease terms also include an option for Shawntana to purchase the leased property at the conclusion of the 30-year term for one dollar ($1.00).

 

In exchange for the Lease, including the purchase option, Shawntana agreed to the following terms:

 

1. Construct 92-single story one-bedroom apartments for rental to low income senior citizens at an affordable rent for 30 years.

 

2. Construct park improvements and a 3.635 square foot community center on an adjacent parcel retained by the County of Orange.

 

3. Pay Lease fees of $3,000 per month for the 30-year term which was to be directed toward the maintenance of the park and operation of the community center.

 

Shawntana has complied with these Lease terms and has confirmed its intent to exercise the option to purchase the property at the expiration of the Lease, in March, 2017. 

 

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
