RECOMMENDED ACTION(S)
Acting as the Board of Supervisors and the Orange County Flood Control District:

Find that the recommended action is statutorily exempt from the provisions of CEQA pursuant to Section 15262 of the CEQA Guidelines. |

Execute Amendment No. 2 to Agreement No. D03-004 with Steinberg & Associates, for one (1) year effective March 9, 2006 through March 8, 2007, with the original monetary limit of $150,000 to remain the same for the three (3) year contract period. |
SUMMARY:
Execute Amendment No. 2 to Agreement D03-004 with Steinberg & Associates for A/E consultant services and technical assistance/support for matters relating to the Santa Ana River Mainstem project and Watershed and Coastal Resources' projects (including feasibility studies and ecosystem restoration projects) involving the U. S. Army Corps of Engineers.
BACKGROUND INFORMATION:
Steinberg & Associates has provided A/E consultant services and technical assistance and support to the Orange County Flood Control District (OCFCD) and RDMD/Watershed and Coastal Resources staff (Watershed), under Agreement D03-004 since March 9, 2004. Dr. Bory Steinberg's understanding of the U. S. Army Corps of Engineer (Corps) policies has enabled him to be very effective in negotiating with Corps' senior staff on the Santa Ana River Mainstem Project, as well as on Watershed's Upper Newport Bay Ecosystem Restoration project and the federal cost-share agreement for Aliso Creek.
Dr. Steinberg's recommendations and guidance have often been critical in influencing funding and policy decisions which impact the County of Orange. Support from Steinberg & Associates has been essential to ensure federal projects are funded and kept on schedule. RDMD requests the continued use of Steinberg & Associates through March 8, 2007, for the Santa Ana River Mainstem/Prado Dam project and for Watershed projects involving the Corps' (including ecosystem restoration projects and feasibility studies). Dr. Steinberg's services will be used on an as-needed basis, as flood control and watershed issues arise with the Corps.
Amendment No. 2 has been negotiated to renew the A/E consultant agreement for the final year of the three-year agreement with Steinberg & Associates through March 8, 2007, and is presented for your Board's consideration. All other terms and conditions of the original agreement shall remain the same.
COMPLIANCE WITH CEQA: The subject project is statutorily exempt from the provisions of CEQA pursuant to Section 15262. Following completion of any design, analysis or permit feasibility assessment associated with this contract, implementation will be accomplished through a future construction contract for which ASRs for advertisement and award of bid will be sent to your Board. Additional CEQA review will occur prior to those Board Actions.
