RECOMMENDED ACTION(S)
1. Adopt the attached Resolution approving Agreement No. D06-011 (Master Agreement for State Funded Projects, District 12 Agreement No. 000529), effective as of December 1, 2005.
2. Approve Agreement No. D06-011 (Master Agreement for State Funded Projects, District 12 Agreement No. 000529) with the State of California (CalTrans) effective as of December 1, 2005.
3. Authorize the Director of Resources & Development Management Department, or his designee, to execute, on behalf of the County of Orange, the Program Supplement Agreements as described in Agreement No. D06-011 (Master Agreement for State Funded Projects, District 12 Agreement No. 000529) in which the matching funds detailed in the individual Program Supplement Agreements do not exceed $500,000.
SUMMARY:
Adopt resolution approving master agreement with State of California (CalTrans) and authorize the Director of Resources & Development Management Department, or his designee, to sign Program Supplement Agreements made pursuant to the agreement in which the matching funds do not exceed $500,000.
BACKGROUND INFORMATION:
The State of California Department of Transportation (CalTrans) has established programs to provide funding to local agencies for various transportation improvements. These programs are administered by CalTrans. In order to participate in these programs, local agencies must enter into a cooperative agreement with CalTrans agreeing to the terms for participating in these programs. A Master Agreement, adopted only once, provides the general terms of the program participation, followed by separate project-specific agreements known as Program Supplement Agreements. This Master Agreement contains a mutual indemnification clause. CEO Risk Management has reviewed and has approved the indemnification language in this agreement.
Authority for the Director of Resources & Development Management Department, or his designee, to sign the Program Supplement Agreements is also requested. As individual projects are approved by CalTrans, separate Program Supplement Agreements will be processed for each individual project. Although the requested action will not require the Board to approve each individual Program Supplement Agreement, the Board will be aware of each of these projects through the budget process, when the plans, specifications, & estimate for each project is processed for Board approval, and when the design, engineering, and/or construction contracts are processed for Board approval. A Program Supplement Agreement will be processed for Board approval if Resources & Development Management Department determines that the matching funds detailed in a Program Supplement Agreement exceed $500,000.
COMPLIANCE WITH CEQA: The subject activity is not a project as defined by CEQA pursuant to Section 15378 of the CEQA Guidelines.
FINANCIAL IMPACT:
Revenue from grants is subject to program procedures and rules of eligibility. Dollar amounts and fiscal years are subject to change.
