RECOMMENDED ACTION(S)

 

 

1.

Find that the proposed  project is categorically exempt (Class 1) from the provisions of

CEQA pursuant to Section 15301 of the CEQA Guidelines.

 

2.

Authorize the Purchasing Agent to issue Price Agreement N1000007205 for Annual Tree Maintenance Services to Great Scott Tree Service, Inc. for the period of one year effective April 1, 2006 through March 31, 2007 in an amount not to exceed $725,000.

 

3.

Direct RDMD to return to the Board for approval of the agreement for two additional one-year periods as Price Agreement N2000007205 for the second year and N3000007205 for the third year.

 

 

 

SUMMARY:

 

Authorize the Deputy Purchasing Agent to contract for annual tree maintenance for various locations within the County of Orange.

 

 

 

 

BACKGROUND INFORMATION:

 

Resources & Development Management Department (RDMD) has prepared a scope of work and has received bids to provide annual tree maintenance services for various locations within the jurisdiction of the County of Orange and cities served by the County. Work shall consist of trimming street trees for vehicle and pedestrian clearance, flood control right-of-way tree trimming and tree removals. Emergency work such as removal of hanging limbs and downed trees is also included.  Locations will be countywide in unincorporated areas owned by the County of Orange, Orange County Flood Control District, Harbors, Beaches and Parks and in the following contracted cities served by the County:  Laguna Hills, Lake Forest, Laguna Woods.

 

RDMD/Operations & Maintenance advertised the bid on the Internet to seventy-five (75) vendors and mailed out twenty-seven (27) bids to interested vendors. Five (5) responsive, responsible bids were received and two (2) no-bids. The responsive bids are as follows:

Great Scott Tree Service, Inc. is the lowest, responsive, responsible bidder based on the greatest number of low bid items (5 of 9 items).  The vendor agrees to provide the requested service for the annual contract without exceeding the budgeted amount of $725,000.

  

Payment for this service will be based on an on-call basis.

 

Bid award is recommended to Great Scott Tree Service, Inc. as the lowest, responsive, responsible bidder.

 

A copy of the proposed price agreement is on file in the office of the Clerk of the Board.

 

Following RDMD’s decision to award the contract to Great Scott, a second bidder, West Coast Arborists, Inc. filed a written protest of the award.  On December 8, 2005 a panel of the County of Orange Procurement Appeals Board conducted a hearing to consider the protest.  On January 13, 2006 the Appeals Board issued their decision.  The Appeals Board found no evidence of impropriety, bias or irregularity in the procurement process and that it was within RDMD’s discretion to base its award criteria on the greatest number of low bids items. 

 

West Coast Arborists, Inc. has expressed their intention to protest the award to Great Scott and the Appeals Board decision at the Board meeting approving the award of this contract.
