RECOMMENDED ACTION(S)

 

 

1.

Find that the proposed project is categorically exempt from CEQA per Section 15316, Class 16 of the CEQA Guidelines.

 

2.

Accept the Quitclaim Deed from the Transportation Corridor Agency and direct the Clerk to return the signed deed to RDMD Right of Way Engineering for recordation.

 

 

 

SUMMARY:

 

RDMD requests the acceptance of the excess portions of Transportation Corridor Agency property for addition to O'Neill Regional Park.

 

 

BACKGROUND INFORMATION:

 

On November 17, 1994 Rancho Santa Margarita Joint Venture (Offeror) irrevocably offered to dedicate in fee to the County that certain property commonly referred to as "Chiquita Ridge".  The dedication was required by the conditions of approval of the Rancho Santa Margarita Planned Community Development.  The offer was recorded on October 27, 1995 as Document No. 19950479055, and accepted by the County for addition to O'Neill Regional Park by Board Resolution No. 95-682, which was recorded on October 27, 1995 as Document No. 19950479057. 

Section 1.11(a) of the Irrevocable Offer of Dedication states: "Offeror has reserved from this offer that certain real property described and delineated on Exhibit D hereto (the "Foothill Transportation Corridor Property").  Following completion of construction of the Foothill Transportation Corridor, Offeror or the Transportation Corridor Agency may execute and deliver to County and County shall accept and record a quitclaim deed or deeds quitclaiming to County those portions of the Foothill Transportation Corridor Property not needed for the Foothill Transportation Corridor."  Pursuant to this section, attached for your Board's acceptance is a deed from the Transportation Corridor Agency for quitclaiming the excess portions (containing 52 acres, more or less) of the corridor land to the County.

 

California Environmental Quality Act:  In accordance with CEQA Guidelines, Section 15316, Class 16, the proposed project is exempt from the provisions of CEQA, which reflects the independent judgment of the lead agency, Orange County, and satisfies the requirements of CEQA because it involves the transfer of land to create additional parkland.

 

General Plan Conformity:  This project is in conformity with the City of Rancho Santa Margarita General Plan.

 

Hazardous Materials Assessment:  The Hazardous Materials Assessment that was performed on November 22, 2005 for this project recommended that the property transfer proceed.

 

 

FINANCIAL IMPACT:

 

$1,300 for annual maintenance.
