RECOMMENDED ACTION(S):

 

 

1.

Ratify and approve the retroactive submittal of the grant applications for Abandoned Watercraft Abatement Grant and Vessel Turn-In Program Grant through the State of California, Department of Parks and Recreation.

 

 

2.

Accept Abandoned Watercraft Abatement Grant in the amount of $25,000 and Vessel Turn-In Program Grant in the amount of $5,000 through the State of California, Department of Parks and Recreation for FY 13-14 and FY 14-15.

 

 

3.

SUMMARY:

 

The Sheriff-Coroner requests that the Board ratify grant applications, accept Abandoned Watercraft Abatement Grant in the amount of $25,000 and Vessel Turn-In Program Grant in the amount of $5,000 through the State of California, Department of Parks and Recreation, and authorize Sheriff-Coroner Sandra Hutchens or authorized Deputy to execute, on behalf of the County of Orange, related grant agreements in an amount totaling $30,000.

 

 

BACKGROUND INFORMATION:

 

The State of California Department of Parks and Recreation, Boating and Waterways Division has two grants available to assist the County of Orange in maintaining safe waterways, which includes 42 miles of coastline, 3 miles offshore, and the inner harbors of Huntington, Newport and Dana Point. 

 

The first grant opportunity is a two-year Abandoned Watercraft Abatement Fund (AWAF) Grant in the amount of $25,000 annually.  The funds provided by the AWAF grant are intended to be used by Sheriff's Harbor Patrol for the abatement, removal, storage, and/or disposal of abandoned vessels which pose water hazards.  An abandoned vessel is defined as "any hulk, derelict, wreck, or parts of any ship, vessel, or other watercraft sunk, beached, or allowed to remain in an unseaworthy or dilapidated condition upon publicly-owned submerged lands, salt marsh, or tidelands within the corporate limits of any municipal corporation or other public corporation or entity having jurisdiction or control over those lands, without its consent expressed by resolution of its legislative body, for a period longer than 30 days without a watchman or other person being maintained upon or near and in charge of the property."  Grant funds will be used to transport abandoned vessels to a company for their destruction and disposal, and to store the vessels until they can be disposed of.

 

The Vessel Turn-In Program (VTIP) Grant is a two-year grant in the amount of $5,000 annually.  The funds provided through this grant shall be used for the removal and disposal of surrendered vessels which are in danger of being abandoned and have a likelihood of causing environmental degradation or become a hazard to waterway navigation. With the recent economic impacts, many vessel owners have abandoned their vessels on moorings and public anchorages.  Grant funds will be used by Harbor Patrol to transport abandoned vessels to a company for their destruction and disposal, or to store the vessels until they can be disposed of.

 

Harbor Patrol submitted an application to the State Division of Boating and Waterways for these grant funds without seeking Board approval in April 2013.  The Division of Boating and Waterways traditionally administered this grant.  From April – December 2013, the State Department of Parks and Recreation restructured and added the Division of Boating and Waterways to its structure.  This reorganization resulted in a months-long delay of the grant award notification.  Harbor Patrol was advised of the grant policy and will submit requests accordingly moving forward.

 

The Sheriff-Coroner requests that the Board ratify grant applications submitted to the State of California in April 2013, accept Abandoned Watercraft Abatement Grant in the amount of $25,000 and Vessel Turn-In Program Grant in the amount of $5,000 through the State of California, Department of Parks and Recreation, and authorize Sheriff-Coroner Sandra Hutchens to execute, on behalf of the County of Orange, related grant agreements in an amount totaling $30,000.

 

 

 

 

 

FINANCIAL IMPACT:

 

The proposed grants provide for revenue to offset costs, resulting in no cost impact to OC Parks or Tidelands Funds.  This grant funding is a nominal amount which does not require any modification for the Sheriff-Coroner's current FY 2013-14 budget.
