RECOMMENDED ACTION(S):

 

 

1.

Find that approval of the Sponsor Agreements with the Orange County Conservation Corps and the California Conservation Corps is Categorically Exempt from CEQA pursuant to CEQA Guidelines Section 15301 (Class 1 - Existing Facilities) and that approval of the Sponsor Agreement with the Orange County Conservation Corps is also Exempt from CEQA pursuant to CEQA Guidelines Sections 15250 and 15251(i) (Certified State Regulatory Programs).

 

2.

Approve and authorize the Chair of the Board to execute the Sponsor Agreement (Agreement No. OCP14-003) with the Orange County Conservation Corps effective February 1, 2014 through January 31, 2015 in an amount not to exceed $200,000; with the option to renew for three additional one-year periods.

 

3.

Approve and authorize the Chair of the Board to execute the Sponsor Agreement (CCC-96) and the Agreement Addendum with the California Conservation Corps effective February 1, 2014 through January 31, 2015 in an amount not to exceed $75,000; with the option to renew for three additional one-year periods.

 

4.

Authorize the OC Parks Director or designee to execute Agreement Addendums with the California Conservation Corps for years two, three and four of the Sponsor Agreement (CCC-96).

 

 

 

 

SUMMARY:

 

Approval of the Sponsor Agreements with the Orange County Conservation Corps and the California Conservation Corps will support the maintenance of OC Parks.

 

 

 

BACKGROUND INFORMATION:

 

The California Conservation Corps (CCC), a State agency, and the Orange County Conservation Corps (OCCC), a private non-profit organization, provide training for young men and women to develop their job skills. The two organizations provide supervised crews to support a variety of activities, such as storm and fire preparation and recovery; trail repair; habitat restoration; and removal of weeds and exotic plants.

 

Sponsor Agreements have been negotiated with the two organizations to supplement OC Parks’ own maintenance and emergency response resources. The two organizations are responsible for crew training, transportation, and supervision as well as provision of most of the equipment. 

 

Contracting with both organizations is important as the service and equipment capabilities of the CCC and the OCCC are different. For example, the OCCC crews are capable of providing the biological monitoring oversight needed when applying herbicides in environmentally-sensitive areas. Additionally, the OCCC crews are more likely than CCC crews to be available in Orange County during a statewide storm or fire emergencies.

 

The recommended Sponsor Agreements are for one-year terms, renewable for three one-year periods. The annual amount for the CCC is a not-to-exceed $75,000. Costs per crewmember for the CCC are $18.77 per hour. The annual amount for the OCCC is a not-to-exceed $200,000. However, OCCC will be providing an in-kind labor match of up to $50,000 annually (utilizing non-County sources of funding); this effectively enables the County to receive up to $250,000 of work. Costs per crewmember for the OCCC are $19.00 and $21.00 per hour depending on the type of work involved.

 

The Sponsor Agreement with CCC contains a mutual indemnification provision which varies from the County standard of sole indemnification. CEO/Risk Management has reviewed the indemnification provision and determined the risk to be acceptable for these services.

 

Compliance with CEQA: Approval of the OCCC and CCC Sponsor Agreements is exempt from the provisions of CEQA pursuant to Section 15301 (Class 1 – Existing Facilities) because they involve the continued maintenance of County of Orange facilities. Approval of the OCCC Sponsor Agreement is also exempt from the provisions of CEQA because it involves work that will be performed in compliance with a pesticide regulatory program administered by the Department of Pesticide Regulation and the county agricultural commissioners (CEQA Guidelines Sections 15250 and 15251(i), Exemption for Certified State Regulatory Programs).
