SUMMARY:

The Health Care Agency requests approval of the Master Memorandum of Understanding for Project-Based Vouchered Mental Health Services Act Housing Project with various providers.

BACKGROUND INFORMATION:

The State of California's Mental Health Services Act (MHSA) Housing Program requires, among other things, that a signed Memorandum of Understanding (MOU) be reviewed by all parties and submitted to the California Housing Finance Association (CalHFA) and the Department of Health Care Services (DHCS) 120 days prior to the leasing of any newly developed project.

This MOU, between Health Care Agency, the developers, property managers, and service providers, will be used for three MHSA Housing projects that have Project-Based Vouchers i.e. Doria II, San Clemente Seniors, and Cerritos Family Apartments. It includes mutual indemnification provision, which varies from the County standard of sole indemnification. CEO/Risk Management has approved the indemnification provisions and determined the risk to be acceptable for these services.

The Health Care Agency requests your Honorable Board approve the master Memorandum of Understanding for provision of Project-Based Vouchered Mental Health Services Act Housing Projects, as referenced in the recommended actions.
