RECOMMENDED ACTION(S):

 

 

1.

Find that Final EIR No. 585, previously certified by the Board of Supervisors on September 18, 2007, together with Addendum IP 08-457 dated April 7, 2009, and Addendum IP 09-269 dated November 24, 2009, reflect the independent judgment of the County and satisfy the requirements of California Environmental Quality Act (CEQA) for the Alton Parkway Project (Project), of which the habitat restoration work described in this item is a necessarily included element contemplated as part of the larger action. 

 

 

a.

The circumstances of the Project are substantially the same and EIR No. 585, Addendum IP 08-457, and Addendum IP 09-269 adequately addressed the effects of the proposed project.  No substantial changes have been made in the Project; no substantial changes in the circumstances under which the Project is being undertaken; and no new information of substantial importance to the Project, which was not known or could not have been known when the previous EIR No. 585, was certified has become known and no further environmental review is required.

 

 

b.

EIR No. 585, together with Addendum IP 08-457, and Addendum IP 09-269, are adequate to satisfy the requirements of CEQA for the Alton Parkway Project.

 

 

c.

All mitigation measures are fully enforceable pursuant to CEQA (Public Resources Code Section 21081.6(b) and have either been adopted as conditions, incorporated as part of the project design, or included in the procedures of project implementation.

 

2.

Approve Architect-Engineer Agreement No. D13-089 between the County, the Orange County Flood Control District, and LSA Associates for on-call habitat creation, restoration, and enhancement services in a total amount not to exceed $400,000 with a term of three years effective upon the Board's approval.

 

 

 

 

SUMMARY:

 

Approval of Agreement No. D13-089 with LSA Associates for on-call habitat creation, restoration, and enhancement services will supplement County resources in fulfilling regulatory mitigation requirements for the Alton Parkway Project and for other road and flood projects in a timely manner.

 

 

 

BACKGROUND INFORMATION:

 

OC Public Works requires the services of Architect-Engineer (A-E) firms to provide professional as-needed assistance with habitat creation, restoration, and enhancement services generally consisting of the development, implementation, maintenance, and monitoring of mitigation plans in accordance with required regulatory permits.

 

On June 28, 2011, the Board selected seven A-E firms in ranked order to provide on-call habitat creation, restoration, and enhancement services and authorized the OC Public Works Director or designee to negotiate individual agreements on an as-needed basis.  On September 13, 2011, the Board approved an agreement with Recon Environmental, Inc., the first ranked firm on the approved ranked selection list, to provide on-call habitat creation, restoration, and enhancement services for road and flood projects. On March 27, 2012, the Board approved an agreement with Dudek, the second ranked firm on the approved ranked selection list, to provide on-call habitat creation, restoration, and enhancement services for road and flood projects.  On December 18, 2012, the Board approved an agreement with Bonterra Consulting, the third ranked firm on the approved ranked selection list, to provide on-call habitat creation, restoration, and enhancement services for the Alton Parkway Project and other road and flood projects.

 

LSA Associates is ranked fourth on the Board approved habitat creation, restoration, and enhancement services ranked selection list. Agreement No. D13-089 with LSA Associates will provide habitat creation, restoration, and enhancement services for projects including, but not limited to: Alton Parkway on-site and off-site mitigation and various routine maintenance projects in a total amount not to exceed $400,000 for a three year term.

 

Compliance with CEQA:  This proposed habitat restoration work is a necessarily included element of the projects considered in Final EIR No. 585, certified by the Board of Supervisors on September 18, 2007, together with Addendum IP 08-457 dated April 7, 2009, and Addendum IP 09-269 dated November 24, 2009, which adequately addressed the effects of the proposed Project. No substantial changes have been made in the Project; no substantial changes in the circumstances under which the Project is being undertaken; and no new information of substantial importance to the Project, which was not known or could not have been known when the Final EIR No. 585 was certified has become known therefore no further environmental review is required.
