RECOMMENDED ACTION(S):

Authorize the County Purchasing Agent or his authorized Deputy to issue Amendment No. 1 to Contract N1000009636 with SBC Global Services, Inc. dba AT&T Global Services on behalf of Pacific Bell Telephone Company dba AT&T California (AT&T), for Voice, Data and Long Distance Services, to extend the term of the Contract through January 29, 2014 to continue to utilize the State of California's CalNet2 contract with AT&T. |

SUMMARY:
CEO/IT requests approval to issue Amendment #1 to Contract N1000009636 with AT&T, for Voice, Data and Long Distance Services, to extend the term of the Contract through January 29, 2014 to continue to use the State of California's CalNet2 contract with AT&T to obtain voice, data and long distance services for County Agencies/Departments. The County's current contract with AT&T for CalNET2 services expires on January 28, 2013.
BACKGROUND INFORMATION:
The County has been purchasing voice and data services through the State of California’s CalNet 1 and 2 programs since 1999. AT&T is the State of California service provider for voice, data, and long distance services. The CalNet contract has been used by State offices and numerous cities and counties throughout the State. Due to the large number of government entities utilizing CalNet2, the State has obtained rates that the County would be unable to match if contracting separately. In addition, there will be ongoing and annual reviews of pricing and services to help ensure the rates and services remain cost-effective and technologically competitive throughout the life of the contract. CEO/IT has estimated County-wide savings of over $650,000 annually with the CalNet2 rates.
CEO/IT recommends that the County continues with the State’s CalNet program and contract through the State with AT&T for an additional year. The County has the option of terminating the contract immediately, without penalty, if approved funding or appropriations are not forthcoming. The estimated cost for County-wide services is $5.0 million annually. These costs are billed through CEO/IT and charged back to the various County Agencies/Departments.
The CalNet2 contract contains the terms and conditions that the State has negotiated with AT&T. This includes an exclusivity clause which requires the County to purchase contracted services only from AT&T for the first two years of the contract period, but not beyond the Term of the State’s CalNet2 contract, in effect through January 29, 2014. As it is desirable for continuity of service to purchase all services from the same vendor, CEO/IT does not believe this clause poses any risk or issues for the County.
