RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from the California Environmental Quality Act (CEQA), Class 16 (Transfer of Ownership of Land in Order to Create Parks), pursuant to CEQA Guidelines Section 15316.

 

2.

Approve and accept the quitclaim deed from the City of Mission Viejo for Facility/Parcel No. PR51A-912.

 

3.

Approve and accept the trail easement deed from the City of Mission Viejo for Facility/Parcel No. PR51A-913.

 

4.

Approve and execute the quitclaim deed from the County to the City of Mission Viejo for Facility/Parcel No. PR51A-701.2.

 

5.

Request the Clerk to return the original executed quitclaim deeds and trail easement deed to OC Parks for further processing.

 

 

SUMMARY:

Approval of the property exchange between the County and the City of Mission Viejo will add high quality open space property to O'Neill Regional Park, secure real estate rights for the Arroyo Trabuco Riding and Hiking Trail, and support the City’s development of a local dog park.

BACKGROUND INFORMATION:

 

The City of Mission Viejo (City) has been seeking to establish a dog park since 2003. In 2010, a site was selected on vacant land south of James G. Gilleran Park on the easterly side of Felipe Road (Exhibit A: Dog Park Site Map) and adjacent to the Arroyo Trabuco Wilderness section of O’Neill Regional Park. In 2011, City staff contacted OC Parks staff about the City’s request for approximately three acres of County park property to develop the dog park at the same location. Subsequent discussions led to the proposed property exchange described in this report.

 

The County will be quitclaiming 2.71 acres of County park property to the City, shown as the area below the dashed-green property line on Exhibit A, to enable the City to develop the 5.54-acre dog park. The Quitclaim Deed for the County property is attached as Exhibit B.

 

In exchange, the City will be quitclaiming to the County 7.18 acres of City-owned open space land, shown in red-outline on Exhibit C, and granting to the County an easement for riding and hiking trail and open space purposes over 1.54 acres of adjacent City-owned land, shown as a black cross-hatched area on Exhibit C. Both the quitclaim and easement properties are adjacent to the Arroyo Trabuco Wilderness section of O’Neill Regional Park. The Quitclaim Deed for the City property is attached as Exhibit D and the Trail Easement Deed is attached as Exhibit E.

 

The property exchange is favorable to the County in three ways:

 

1.

The County is receiving over three times the amount of open space land from the City than the County is giving to the City.

 

2.

The City property contains high quality habitat.

 

3.

The City property includes the only segment of the County’s Arroyo Trabuco Regional Riding and Hiking Trail over which the County has no real estate rights, either through ownership of the underlying land or through an easement. The property exchange will ensure that OC Parks has real estate rights over the entire length of the trail. 

 

OC Parks recommends your Board’s acceptance of the Quitclaim and Trail Easement Deeds from the City and approval of the Quitclaim Deed to the City to effect the property exchange.

 

OC Parks Commission: The item was considered and approved by the OC Parks Commission at its March 1, 2012 meeting.

 

Compliance with CEQA: The proposed project is Categorically Exempt from the provisions of CEQA pursuant to Section 15316 (Class 16 - Transfer of Ownership of Land in Order to Create Parks) because it involves transfer of land to establish a park where the land is in a natural condition. Any future park improvements to be undertaken by the City of Mission Viejo will be subject to a separate CEQA review.
