Find that, in accordance with CEQA Guidelines, Section 15301, Class 1 (Existing Facilities), the proposed project is exempt from the provisions of CEQA, which reflects the independent judgment of the lead agency, Orange County, and satisfies the requirements of CEQA. The project is exempt because it involves use of an existing facility for the University of California, Irvine (UCI) Police Department for training activities, involving negligible or no expansion of use beyond what currently exists. |

SUMMARY:
The Sheriff-Coroner requests approval of the license agreement between the County of Orange and the Regents of the University of California for the UCI Police Department's rental of portions of the Sheriff’s Katella Training Facility, 1900 W. Katella Ave., Orange. File No. PM 462-6620-03-19-15.
BACKGROUND INFORMATION:
The Sheriff-Coroner operates the County-owned Katella Training Facility located in the City of Orange to provide law enforcement training for the Department, and also for other law enforcement agencies to use for training purposes. To utilize this facility, non-County entities must enter into a license agreement with the County to address liability issues and to set rental amounts. Currently the County has license agreements with several other law enforcement agencies for non-exclusive use of portions of the Katella Training Facility.
The UCI Police Department has requested the use of the Katella Training Facility for training and instruction purposes. Approval of this license agreement with the University of California will allow the UCI Police Department to use the facility, in coordination with other law enforcement agencies' use, to train their officers. The proposed one-year agreement will be effective approximately January 8, 2013 and will automatically extend in one-year increments, unless terminated pursuant to the provisions of the license agreement. The license agreement will allow the UCI Police Department to choose among the shooting ranges, tactical village training, driving and force option simulators, and/or classrooms they wish to use for training. The amount of rental revenue the County receives from the University of California will depend upon which of these individual training options the UCI Police Department selects, and how often it uses them. Rental rates are based upon a review of fair market rents of similar facilities within Orange County. The County may adjust the rental rates annually by no more than five percent to address increases or decreases in the costs to the Sheriff to operate the facilities, or if market rental rates increase.
The costs to the County related to processing this license total approximately $1,100. Pursuant to the agreement, the University of California will pay the County a one-time $1,100 processing fee for this license.
FINANCIAL IMPACT:
Costs to the County are offset by the one-time processing fee and rental revenue paid by the University of California.
