SUMMARY:
Approval of Change Order No. 1 with Prava Construction Services, Inc. will change the exterior features of the construction project at the Dana Point Branch Library community room by adding an earthen berm and concrete band to conform to the original architectural design of the Branch Library.
BACKGROUND INFORMATION:
On April 28, 2008, an Agreement was executed with Prava Construction Services, Inc. to provide construction services for an expansion to the existing community room at the Dana Point Branch Library. This Agreement was not originally approved by your Board since Board approval is not required for Public Works Contracts less than $125,000, per the County's Contract Policy Manual (CPM), Section 3.6. Prior to the start of construction, the City of Dana Point requested design changes that required revisions to the original construction document drawings. By adding an earthen berm and concrete band to the project, these changes match the original architectural features of the Branch Library more closely.
The City of Dana Point has a vested interest in preserving the original architectural features of the Branch Library and has pledged $5,000 to help fund part of this $17,551 change order. The remainder of the funding for the County's portion of the change order will come from the OC Public Libraries' budget in the amount of $12,551.
Because this change order is greater than 10% of the original contract amount of $99,500, Board approval is required per the CPM, Section 3.6. Additionally, due to the delay in the start of construction resulting from this Change Order No. 1, the original contract completion date of August 28, 2008 has been changed to May 19, 2009.
Additionally, per Board policy, all contract renewals and amendments must include a "red-lined" version of the original document illustrating the changes in the renewal or amendment. However, this Change Order No. 1 is not an amendment to the original contract; but to the actual set of drawings which were than submitted to the County building department for approval before the cost for the change was requested from the contractor. Therefore, since no changes to the written contract were made, the Board policy does not apply.
Compliance with CEQA: In accordance with CEQA Guidelines, Section 15301, Class 1, the proposed project is exempt from the provisions of CEQA, which reflects the independent judgment of the lead agency, Orange County, and satisfies the requirements of CEQA because it involves a minor room addition to an existing public facility with no resulting expansion in use of the public facility involved. Because the original Agreement was issued as a purchase order, your Board did not make a CEQA finding for the project. However, since this is the first time the project is before the Board of Supervisors, we are asking your Board to make the CEQA finding at this time.
FINANCIAL IMPACT:
Funding is provided by OC Public Libraries in the amount of $12,551 and the City of Dana Point in the amount of $5,000.
