RECOMMENDED ACTION(S):

 

 

1.

Approve the Administering Agency-State Master Agreement with the State of California, acting through its Department of Transportation, for State-Funded Projects, effective upon execution of all necessary signatures.

 

2.

Adopt a Resolution to authorize the Director of OC Public Works or designee to approve and execute Program Supplement Agreements as described in the Administering Agency-State Master Agreement.

 

 

 

 

SUMMARY:

 

Approval of the Administering Agency-State Master Agreement, adoption of the resolution and related actions will allow the County of Orange to receive state funding for various Countywide transportation improvement projects more efficiently.

 

 


 

BACKGROUND INFORMATION:

 

The State of California has established state-funded programs to provide funding to local agencies for various transportation-related improvements. These programs are administered by the California Department of Transportation (Caltrans). To participate in these programs, local agencies are required to enter into an Administering Agency-State Master Agreement with Caltrans to establish general terms and conditions for participation in these state-funded programs. For each specific project awarded funding, a corresponding Program Supplement Agreement (PSA) is executed to define project-specific scope, schedule and funding requirements.

 

The County of Orange (County) has an existing Board of Supervisors (Board) approved Master Agreement with Caltrans. However, due to regulatory and policy updates, Caltrans now requires all local agencies to enter into a new Master Agreement to remain eligible for continued participation in state-funded programs.

Approved updated Master Agreement No. D08-078 and adopted Resolution No. 08-124 authorizing the Director of OC Road & Flood/Chief Engineer or designee to execute PSAs.

 

 

As future transportation projects are approved for funding by Caltrans, separate PSAs will be submitted for each individual project in accordance with the proposed Master Agreement No. MA-080-26010180 (Master Agreement).

 

OC Public Works recommends the Board approve the Master Agreement and adopt a resolution to authorize the Director of OC Public Works or designee to approve and execute PSAs as described in the Master Agreement.

 

Compliance with CEQA: This action is not a project within the meaning CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action regard to a project since the action authorizes approval of a Master Agreement with Caltrans. This proposed activity is therefore not subject to CEQA. Any further action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.
