RECOMMENDED ACTION(S):

 

Authorize the OC Community Resources Director or designee to execute the Fourth Amendment to renew and amend the contract with Managed Career Solutions, SPC to administer Workforce Innovation and Opportunity Act Title I Career Services for the Adult and Dislocated Worker Program, in an amount not to exceed $3,500,000 commencing on July 1, 2021, through June 30, 2022 for a revised cumulative contract total amount not to exceed $12,612,500.

 

 

 

SUMMARY:

 

Approval of the Fourth Amendment to the Contract with Managed Career Solutions, SPC will support continuation of Workforce Innovation and Opportunity Act Title I Career Services for the Adult and Dislocated Worker Program, employment, training and career services in the County.

 

 

BACKGROUND INFORMATION:

 

 

The Workforce Innovation and Opportunity Act (WIOA) requires the development of a comprehensive workforce investment system under which entities responsible for administering separate employment, training, educational and other human resource programs collaborate to create a unified system of service delivery that will enhance access to program services to improve long-term employment outcomes for individuals receiving assistance. These services are coordinated through the Orange County One-Stop System (One-Stop System), which includes America’s Job Center of California (AJCC)- Garden Grove Comprehensive One-Stop (Comprehensive One-Stop) Center and, currently, four affiliate centers located at the Tustin Emergency Shelter, Los Alamitos Joint Forces Training Base, Theo Lacy Facility and a mobile unit.

 

WIOA requires local Workforce Boards and their Chief Elected Official(s) to select service providers to provide Title I Career Services for the Adult and Dislocated Worker Program (Services). The WIOA Services provider is responsible for providing job seekers with high-quality career services, education, training and supportive services to get good employment and stay employed. Further, the provider is responsible for assisting businesses in finding skilled workers and accessing other support, including education and training for their current workforce. The following partner programs are also required to provide access through the One-Stop System: Career and Technical Education (Perkins Act), Community Services Block Grant, Indian and Native American Programs, Housing and Urban Development Employment and Training Programs, Job Corps, Local Veterans' Employment Representatives and Disabled Veterans' Outreach Program, National Farmworker Jobs Program, Second Chance, Senior Community Service Employment Program, Temporary Assistance for Needy Families, Trade Adjustment Assistance Programs, Unemployment Compensation Programs, Vocational Rehabilitation and YouthBuild. 

 

On October 30, 2018, the Board of Supervisors (Board) approved the list of procured providers deemed eligible through the Request for Proposals (RFP) process to provide Comprehensive One-Stop Services, and authorized OC Community Resources (OCCR) to enter into contract negotiations with Managed Career Solutions, SPC (MCS) and KRA Corporation (KRA). On December 18, 2018, the Board approved OCCR to enter into two 18-month contracts, including:

Comprehensive One-Stop WIOA Services, Business Services – North Region

KRA

Comprehensive One-Stop WIOA Services, Business Services and One-Stop Operator – South Region

 

The Board approved contracts entered into, as a result of this RFP, effective January 1, 2019, through June 30, 2020, with the option to be renewed through December 31, 2022, as allowable under WIOA, not to exceed four years.

 

During the FY 2020-21 renewal process, KRA and the County mutually agreed to not seek a contract renewal for WIOA Services- South Region. Additionally, the Irvine Comprehensive One-Stop Center that KRA operated closed effective June 30, 2020, due to the following: 1. The cost of the Irvine Comprehensive One-Stop Center was too high, 2. The high cost resulted in System Partners not being able to afford to pay rent, therefore, required co-located partners were not at the One-Stop location and 3. The One-Stop Center was located within a ten mile radius of the North Orange County, Santa Ana and Anaheim One Stop Center which left South Orange County residents at a disadvantage  To avoid interruption of Services, MCS agreed to provide the Services Countywide (excluding Anaheim and Santa Ana).

 

As the current provider of WIOA Services and after a review of MCS program performance metrics for the previous contract term, January 1, 2019 through June 30, 2020, detailed in Attachment F, MCS was determined to have satisfactory performance measures for the contract period. Therefore, OCCR requested the Board to renew the Contract with MCS to provide WIOA Services. On June 23, 2020, the Board approved OCCR’s request to renew Contract No. 18-28-0062-OS (Contract) with MCS, under the revised scope of work, to provide WIOA Services in an amount not to exceed $5 million ($2.4 million for Adult and $2.6 million for Dislocated Worker services), effective from July 1, 2020, through June 30, 2021.

 

OCCR is requesting to renew the Contract with MCS to provide WIOA Services, in an amount not to exceed $3.5 million for a Contract term effective, July 1, 2021, through June 30, 2022. The budgeted, not-to-exceed costs for the key categories of services MCS will provide under the Contract are as follows:

As a current provider of WIOA Services and taking the COVID-19 pandemic and restrictions into consideration, and as reflected in Attachment C- MCS’ 2020-21 Program Performance Metrics, MCS’ performance has been confirmed as satisfactory. Therefore, MCS’ program performance metrics and goals will remain unchanged for FY 2021-22 (Attachment E). OCCR has verified that there are no concerns that must be addressed with respect to the Provider’s ownership/name, litigation status or conflicts with County interests. This Contract does not currently include subcontractors or pass through to other providers. See Attachment D for Contract Summary Form.

 

 

 

FINANCIAL IMPACT:

 

 

Appropriations for this Contract are included in Fund 146 FY 2021-22 Budget and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
