RECOMMENDED ACTION(S):

Approve and authorize the County Procurement Officer or authorized Deputy to execute contract with Envent Corporation to provide Mobile Flare Thermal Oxidizer Services at Frank R. Bowerman Landfill, effective February 9, 2021, through February 8, 2022, in an amount not to exceed $3,000,000. Contract is renewable for two additional one-year terms in an amount not to exceed $3,000,000 per year. |
SUMMARY:
Approval of the contract with Envent Corporation to provide mobile flare thermal oxidizer services at Frank R. Bowerman Landfill to supplement collection of landfill gas due to severe damage caused by the Silverado Fire, will support continued landfill operations as well as maintain compliance standards with local, state and federal regulatory agencies.
BACKGROUND INFORMATION:
OC Waste & Recycling is responsible for managing the County of Orange (County) solid-waste disposal system, including Central Region Landfills that consist of the active 725-acre Frank R. Bowerman Landfill (Landfill) and five closed solid-waste disposal sites. The Landfill was opened in 1990 to meet the solid-waste disposal needs of the central portion of the County.
On October 26, 2020, the Silverado Fire caused severe damage to the Landfill’s environmental control systems including downed power lines and damage to the landfill gas collection systems. During this time, mobile thermal oxidizer services with Envent Corporation were acquired under emergency purchase order to supplement collection of landfill gas while permanent repairs to the landfill gas system began. Much of the landfill gas collection system has been repaired; however, the condensate sump system component must wait for parts in order to complete repair. After a thorough assessment it was determined that the mobile thermal oxidizer services would be needed for a minimum of six additional months to supplement the loss in gas generation and prevent the migration and emissions of landfill gas while the landfill collection condensate pump is repaired.
On December 2, 2020, OCWR issued an Invitation for Bids (IFB) for mobile flare thermal oxidizer services at Frank R. Bowerman Landfill. The IFB was posted on the County’s online bidding system. Bidders were requested to provide thermal oxidizer equipment unit size/models, rates for the rental of these equipment and hourly rates for designated labor classifications. Envent Corporation was the sole bidder and was determined to be responsive and responsible. The bid recap is attached as Attachment B.
Services provided by Envent Corporation have been determined to be at least satisfactory. OCWR has verified there are no concerns that must addressed with respect to the contractor’s ownership/name, litigation status or conflicts with County interests. This contract does not currently include subcontractors or pass through to other providers. See Attachment C for Contract Summary Form.
This contract for mobile thermal oxidizer services will be used on an as-needed basis to supplement landfill gas extraction and prevent landfill gas emissions to ensure the Landfill meets stringent local, state and federal regulations.
Compliance with CEQA: The proposed action is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to Section 15301 of the CEQA Guidelines, since Class 1 (Existing Facilities) consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The proposed action is also Categorically Exempt (Class 8) from the provisions of CEQA pursuant to Section 15308 (Actions by Regulatory Agencies for Protection of the Environment), since Class 8 consists of actions taken by a public agency for the protection of the environment. The proposed action is also Categorically Exempt (Class 11) from the provisions of CEQA pursuant to Section 15311 (Accessory Structures), since Class 11 consists of construction or replacement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities. This action will allow for approval of a Contract for mobile flare thermal oxidizer services to supplement the existing landfill gas collection system while permanent repairs are conducted at the FRB Landfill, which is consistent with a Class 1, Class 8, and Class 11 Categorical Exemption determination.
FINANCIAL IMPACT:
Appropriations for this Contract is absorbed in the FY 2020-21 Budget for OC Waste & Recycling Enterprise Fund 299 and will be included in the budgeting process for FY 2021-22.
The Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
