RECOMMENDED ACTION(S):

 

 

Authorize the Director of OC Public Works or designee to execute Amendment No. 1 to renew the Architect-Engineer contracts for On-Call Watershed Management Plan/Water Quality Improvement Plan Development and Implementation, effective February 27, 2021, through February 26, 2023, in an amount not to exceed $1,000,000 each, for a total cumulative amount not to exceed of $7,000,000 and a revised total cumulative amount not to exceed $17,500,000, as follows:

SUMMARY:

 

Approval of Amendment No. 1 to renew the contracts with Tetra Tech, Inc.; Geosyntec Consultants, Inc.; CDM Smith, Inc.; Pacific Advanced Civil Engineering, Inc.; Michael Baker International, Inc.; CWE; and Larry Walker Associates, Inc. for On-Call Watershed Management Plan/Water Quality Improvement Plan Development and Implementation will supplement County of Orange staff and provide specialized expertise in completing and implementing regional watershed management plans. 

 

 

 

BACKGROUND INFORMATION:

 

The County of Orange (County), Orange County Flood Control District and 34 cities of Orange County, collectively the Orange County Stormwater Program (Program), are regulated by National Pollutant Discharge Elimination System Permits (Permits) for stormwater quality under the jurisdiction of both the Santa Ana Regional Water Quality Control Board (SAR; North and Central Orange County) and the San Diego Regional Water Quality Control Board (SDR; South Orange County). The SAR and SDR issue these Permits, which are revised and adopted approximately every five years. The County, as the principal permittee, administers and coordinates compliance program development for the Program. A cost sharing contract between the County and the cities provides funding for consultant support.

 

The SDR regional stormwater permit issued in 2015 to South Orange County is due for renewal and a pending SAR stormwater permit for North Orange County will significantly increase the complexity of stormwater management and program assessment requirements compared to the previous stormwater permit issued in 2009. Technical support is required to provide the following services: preparation and implementation of regulatory compliance plans, such as the Water Quality Improvement Plan that was accepted by the SDR in June 2018; watershed-level planning documents; technical guidance for watershed-level data analysis; and mapping, modeling and development of regional tools in the preparation of watershed plans and other related tasks. Additionally, the County administers Integrated Regional Watershed Management Plans and associated programs on behalf of cities, water agencies and other groups. Technical support is required to provide watershed plan technical review and implementation assistance, watershed planning tool development (e.g. mapping and modeling), grant application support and regional project development.

 

On May 31, 2017, OC Public Works issued a Request for Qualification to solicit a Statement of Qualifications from contractors to provide Architect-Engineer (A-E) On-Call Watershed Management Plan/Water Quality Improvement Plan Development and Implementation (Services).

 

On February 27, 2018, the Board of Supervisors (Board) approved multi-year contracts with Tetra Tech, Inc.; Geosyntec Consultants, Inc.; CDM Smith, Inc.; Pacific Advanced Civil Engineering, Inc.; Michael Baker International, Inc.; CWE; and Larry Walker Associates, Inc. (Contractors) to provide Services in a total amount not to exceed $1.5 million each, for a three-year term, renewable for two additional years.

* Anticipated usage for these contracts is based on watershed management plans that have been or are in the process of being developed, which set goals and schedules for achieving water quality improvement and ultimately, compliance with water quality standards for receiving waters during wet weather.

 

OC Public Works is recommending Board approval of the following amendments to renew the term for two additional years, effective February 27, 2021, through February 26, 2023, in an amount not to exceed $1 million each, for a total cumulative amount not to exceed $7 million and a revised total cumulative amount not to exceed $17.5 million:

The Contractors' performances have been confirmed as at least satisfactory. OC Public Works has verified there are no concerns that must be addressed with respect to Contractors' ownerships/names, litigation status or conflicts with County interests.

 

The contracts include subcontractors. See Attachment O for information regarding subcontractors and the Contract Summary Form.

 

Prior to expiration of the contracts, OC Public Works plans to issue a solicitation to continue Services.

 

In accordance with the 2020 Design and Construction Procurement Policy Manual Section 3.3-102 and pursuant to California Government Code Section 25502.5, approval by the Board is required for all A-E services contracts in excess of $200,000.

 

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project, since the item only concerns approval of contracts for Services. This proposed activity is therefore not subject to CEQA. Any individual, specific work authorized pursuant to this contract will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the contracts are included in the FY 2020-21 Budget for OC Flood, Fund 400, at 10 percent; Watershed, Budget Control 034, at 4.7 percent; OC Road, Fund 115, at 4.7 percent; OC Parks, Fund 405, at 4.7 percent; and Cities at 75.9 percent and will be included in the budgeting process for the future years.

 

The proposed contracts include a provision stating the contracts are subject to, and contingent upon, applicable budgetary appropriations approved by the Board for each fiscal year during the term of these contracts. If such appropriations are not approved, these contracts may be immediately terminated without penalty to the County.
