RECOMMENDED ACTION(S):

 

 

1.

Authorize the County Procurement Officer or authorized Deputy to execute Amendment No. 1 to renew the aggregate contract with The Code Group, Inc. for On-Call Code Enforcement Services, effective March 15, 2021, through March 14, 2022, in an aggregate amount not to exceed $300,000, for a revised cumulative aggregate contract total amount not to exceed $1,200,000, renewable for an additional one-year term.

SUMMARY:

 

Approval of Amendment No. 1 to the aggregate contract with The Code Group, Inc. and Amendment No. 2 to the aggregate contract with Willdan Engineering and HR Green Pacific, Inc. for On-Call Code Enforcement Services will fill service gaps and maintain continuity and facilitation of responses in the County of Orange unincorporated areas.

 

 

 

BACKGROUND INFORMATION:

 

OC Public Works Code Enforcement Division utilizes On-Call Code Enforcement Services (Services) to avoid gaps in service by maintaining reliable access to vendor resources to ensure continuous and responsive service to County of Orange (County) unincorporated areas.

 

On March 15, 2016, the Board of Supervisors (Board) approved aggregate Contract MA-080-16011526 with AndersonPenna Partners, Inc. and Singh Group, Inc. for a one-year term for Services in an amount not to exceed $300,000, renewable for four additional one-year terms. In September of 2017, OC Public Works determined that the aggregate contract would not be renewed due to the inadequate level of resources provided by the contractors.

 

On October 5, 2017, OC Public Works issued a Request for Proposal (RFP) for Services. The RFP was advertised on the County online bidding system. A total of four proposals were received and evaluated. On October 24, 2017, the evaluation committee completed the written evaluation process and provided its recommendations. 

 

On February 6, 2018, the Board approved aggregate Contract MA-080-18010951 (Contract) with The Code Group, Inc., Willdan Engineering and HR Green Pacific, Inc. for a three-year term, effective March 15, 2018, through March 14, 2021, in an aggregate amount not to exceed $900,000, renewable for two additional one-year terms.

 

On March 15, 2018, the Deputy Purchasing Agent executed Amendment No. 1 to the aggregate Contract with Willdan Engineering and HR Green Pacific, Inc. for Services to correct the pricing in Attachment B.

OC Public Works is recommending Board approval of Amendment No. 1 to the aggregate Contract with The Code Group, Inc. and Amendment No. 2 to the aggregate Contract with Willdan Engineering and HR Green Pacific, Inc. (Contractors) for Services, to renew the Contract for an additional one-year term, effective March 15, 2021, through March 14, 2022, in an aggregate total amount not to exceed $300,000, for a revised cumulative aggregate Contract total amount not to exceed $1.2 million. The work is assigned to whichever contractor is available and, depending upon the request, work can be assigned to multiple contractors at the same time.

 

The Contractors’ performances have been confirmed as satisfactory. OC Public Works has verified there are no concerns that must be addressed with respect to Contractors' ownerships/names, litigation status or conflicts with County interests.

 

The Contract does not include subcontractors or pass through to other providers. See Attachment G for Contract Summary Form.

 

In accordance with Section 3.3-102 of the County Contract Policy Manual, approval by the Board is required for all service contracts where, for any year of the contract, the annual value to any one contractor exceeds $200,000.

 

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project since it only authorizes execution of an aggregate contract. This proposed activity is therefore not subject to CEQA. Any individual, specific work authorized pursuant to this Contract will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the aggregate Contract are included in the FY 2020-21 Budget for OC Public Works, Budget Control 080, and will be included in the budgeting process for future years.

 

The proposed aggregate Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, the Contract may be immediately terminated without penalty to the County.
