RECOMMENDED ACTION(S):

Authorize the County Procurement Officer or authorized Deputy to execute an aggregate contract with Williams & Maher, Inc.; Baker Electric, Inc.; Minako America Corporation dba Minco Construction; and M.B. Herzog Electric, Inc. for Electrical Systems Maintenance and Repair Services, effective January 10, 2022, through January 9, 2025, in an aggregate amount not to exceed $750,000, with the option to renew for one additional two-year term upon Board of Supervisors approval. |
SUMMARY:
Approval of an aggregate contract for Electrical Systems Maintenance and Repair Services will allow OC Public Works to support electrical maintenance, repairs and alterations for electrical systems to County of Orange facilities.
BACKGROUND INFORMATION:
OC Public Works provides Countywide services, which include maintenance, repair and alterations of electrical systems and equipment. The County of Orange (County) is required on an annual basis to ensure that electrical services are functional at the level expected.
On September 14, 2021, OC Public Works issued an Invitation for Bid for Electrical Systems Maintenance and Repair Services (Services) on the County online bidding system. Five bids were received; four were deemed responsive and one was deemed non-responsive. The Bid Summary is included as Attachment F.
OC Public Works is procuring these Services in accordance with the 2021 Contract Policy Manual Section 3.3-102.
The Orange County Preference Policy (OCPP) was
applicable and incorporated into this solicitation. There were no OCPP
qualified proposals submitted.

OC Public Works is recommending the Board of Supervisors (Board) approve aggregate Contract MA-080-22010288 with Williams & Maher, Inc., Baker Electric, Inc., Minako America Corporation dba Minco Construction and M.B. Herzog Electric, Inc. (Contractors) for Services, effective January 10, 2022, through January 9, 2025, in an aggregate amount not to exceed $750,000, with the option to renew for one additional two-year term upon Board approval. The work will be assigned to whichever contractor is available and, depending upon the request, work can be assigned to multiple contractors at the same time.
OC Public Works has conducted due diligence on the Contractors. Reference checks were satisfactory and completed with the following entities regarding similar services. OC Public Works has verified there are no concerns that must be addressed with respect to the Contractor’s ownership/name, litigation status or conflicts with County interests.

The Contract with Baker Electric, Inc. includes subcontractors. All other Contracts do not currently include subcontractors or pass through to other providers. See Attachment E for information regarding subcontractors and the Contract Summary Forms.
Compliance with CEQA: The proposed project is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to CEQA Guidelines Section 15301, because it is a contract to maintain and repair electrical systems for existing public facilities involving negligible or no expansion of existing use.
FINANCIAL IMPACT:
Appropriations for the Contract are included in the FY 2021-22 Budget for OC Public Works, Budget Control 080, and will be included in the budgeting process for future years.
The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
