RECOMMENDED ACTION(S):
Authorize the County Procurement Officer or authorized Deputy to execute Amendment No. 2 to the aggregate contract with Omega Fire Inc. doing business as Kord Fire Protection and Majestic Fire Inc. for Fire Extinguisher and Fire Hose Maintenance Services, effective February 1, 2022, to November 30, 2023, in an aggregate amount not to exceed $330,000, for a revised cumulative contract total amount not to exceed $841,500.
SUMMARY:
Approval of Amendment No. 2 to renew the aggregate contract for Fire Extinguisher and Fire Hose Maintenance Services will allow OC Public Works to remain in compliance with building, fire and safety codes, which require inspections, repairs and replacements and will support public and employee safety within County of Orange facilities.
BACKGROUND INFORMATION:
OC Public Works provides Countywide services, which include routine inspections, repairs and maintenance services for existing County of Orange (County) fire extinguishers and hoses. Fire Extinguisher and Fire Hose Maintenance Services (Services) are required to maintain safety, government code or regulatory permitting requirements. To continue efficient operation and management of County facilities, it is necessary to retain contractors for Services to supplement staff and provide specialized expertise.
On August 17, 2018, the County Procurement Office (CPO) issued an Invitation for Bid (IFB) for Services on the County online bidding system. Four bids were received, reviewed and evaluated by CPO representatives to determine if the submitted prices in the bids were fair and reasonable. CPO issued a Regional Cooperative Agreement RCA-017-19010003 with Omega Fire Inc. doing business as Kord Fire Protection and Majestic Fire Inc. (Contractors), effective December 1, 2018, through November 30, 2023.
On January 29, 2019, the Board of Supervisors (Board) approved subordinate Contract MA-080-19010921 (Contract) with the Contractors, in an aggregate amount not to exceed $511,500, effective February 1, 2019, through January 31, 2022.
On October 24, 2019, the Deputy Purchasing Agent executed Amendment No. 1 to the Contract to update service locations.
OC Public Works is procuring these Services in accordance with the 2021 Contract Policy Manual Section 3.3-102. The Orange County Preference Policy was not applicable when the IFB for Services was issued in August 2018.

OC Public Works is recommending Board approval to authorize the CPO or authorized Deputy to execute Amendment No. 2 to aggregate Contract with Contractors for Services, effective February 1, 2022, through November 30, 2023, in an increase not to exceed $330,000, for a revised cumulative contract total amount not to exceed $841,500.
The Contractors' performances have been confirmed as at least satisfactory. OC Public Works has verified there are no concerns that must be addressed with respect to Contractors’ respective ownerships/names, litigation status or conflicts with County interests.
The Contract does not currently include subcontractors or pass through to other providers. See Attachment E for the Contract Summary Forms.
Prior to contract expiration, OC Public Works plans to issue a solicitation to continue Services.
Compliance with CEQA: The proposed project was previously determined to be Categorically Exempt from CEQA pursuant to Section 15301 (Class 1) of the CEQA Guidelines, on January 29, 2019, when it was originally approved by the Board because it concerns the maintenance, and repair and replacement of existing fire extinguishers and fire hoses with negligible or no expansion of existing use. The proposed project is still consistent with this determination.
FINANCIAL IMPACT:
Appropriations for the aggregate Contract are included in the FY 2021-22 Budget for OC Public Works, Budget Control 080: 59 percent; OC Fleet, Fund 296: 35 percent; OC Watersheds, Budget Control 034: 1 percent; OC Road, Fund 115: 1 percent; and OC Flood, Fund 400: 4 percent, and will be included in the budgeting process for future years.
The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
