RECOMMENDED ACTION(S):

 

 

1.

Approve Final Tract Map 19025 pursuant to Section 66436(a)(3) of the Subdivision Map Act.

 

2.

Approve the Subdivision Improvement Agreement with Pulte Home Company, LLC, a Michigan limited liability company, and accept bonds guaranteeing construction of improvements.

 

3.

Accept the dedication of the easements for emergency access, public utility and public service vehicle ingress and egress purposes as shown on Final Tract Map 19025.

 

4.

Accept dedication of an easement for public and public utility for street purposes on Ivy Way as shown on Final Tract Map 19025.

 

 

 

 

SUMMARY:

 

Approval of Final Tract Map 19025, the Subdivision Improvement Agreement and actions related to dedication of easements and vehicular access rights will provide streets, streetlights, sewer, water, storm drain and monumentation for the portion of Planning Area 3, Subarea 3.1 of the Ranch Plan Planned Community within its bounds.  

 

 

 

BACKGROUND INFORMATION:

 

The area depicted in Final Tract Map (FTM) 19025 is located in the southeastern portion of unincorporated Orange County, north of Cow Camp Road, on the northeasterly corner of Saddle Way and Ranch Canyon, within the Ranch Plan Planned Community (RPPC). The tract is located within Planning Area 3, Subarea 3.1, Lots 1 through 11, 74, KK and T of “A” Tract Map 17931, of the RPPC.

 

On November 8, 2004, the Board of Supervisors (Board) approved a General Plan Amendment (Resolution No. 04-291); Zone Change (Resolution No. 04-292 and Ordinance No. 04-014); Development Agreement (Resolution No. 04-293 and Ordinance No. 04-015); and adopted Resolution No. 04-290, certifying Final Environmental Impact Report (FEIR) No. 589 as complete, adequate and in full compliance with the requirements of CEQA for the entire 22,815-acre area of the RPPC.

 

Subsequent settlement agreements regarding: 1) regional transportation impacts associated with implementation of the RPPC and 2) the appropriate/desired scope of biological resource protection to be implemented within the boundaries of the RPPC were finalized in August 2005.

 

The Master Area Plan and Subarea Plans (Plans) for Planning Areas 3 and 4, including Subarea 3.1, were originally approved on February 25, 2015, by the Planning Commission (PC) (PA140072 - PA140081) and revised administratively on May 22, 2017, (PA150047). On September 11, 2019, the PC approved amendments and revisions to the Plans for Planning Areas 3 and 4 (PA180030) that reflect plans to develop Planning Area 3 in smaller phases. Subsequently, “A” Vesting Tentative Tract Map (VTTM) 17931 was approved by the Subdivision Committee on November 20, 2019. Revision No. 1 to VTTM 17931 was administratively approved by the OC Public Works Director in November 2020. FTM 17931 was approved by the Board on December 8, 2020, and recorded with the Orange County Clerk Recorder on December 18, 2020.

 

On April 21, 2021, the Subdivision Committee approved VTTM 19025, which represents a further subdivision of FTM 17931 and is part of the final development plan for Subarea 3.1.

 

Proposed FTM 19025 provides for the development of an 8.145-acre site into 104 legal lots: 73 numbered lots for planned concept single-family detached dwellings; eight numbered lots for pocket parks and landscaping; one lettered lot for a public street; 12 lettered lots for private streets and alleys; and 10 lettered lots for landscaped open space areas.

 

The County of Orange (County) Surveyor has reviewed proposed FTM 19025 and has determined that it is in compliance with all conditions of approval and is in conformance with all applicable codes and regulations.

 

County acceptance of the dedication of the easements shown on FTM 19025 provides for emergency access, public utility and public service vehicle access for purposes of public health, welfare and safety.

 

Compliance with CEQA: The project is a necessarily included element of the projects considered in FEIR No. 589, which was certified by the Board on November 8, 2004, as well as the following addenda: Addendum 1.0, approved on July 26, 2006, by the PC (PA06-0023); Addendum 1.1, approved on February 24, 2011, by the Interim Director of OC Public Works (PA11-0003 through PA110006); the Planning Area 2 Addendum, approved on March 27, 2013, by the PC (PA130001 through PA130004 and PA130006); and Addendum 3.1, approved February 25, 2015, by the PC (PA140072-81). The FEIR and addenda adequately addressed the effects of the proposed project. No subsequent changes have been made in the project; no substantial changes have occurred in the circumstances under which the project is being undertaken; and no new information of substantial importance to the project that was not known or could not have been known when FEIR No. 589, Addendum 1.0, Addendum 1.1, the Planning Area 2 Addendum and Addendum 3.1 were certified and approved have become known; therefore, no further environmental review is required.
