RECOMMENDED ACTION(S):

 

 

Authorize the OC Waste & Recycling Director or Deputized designee, per delegated authority from OC Public Works Director, to execute Amendment Number One to renew the Architect-Engineer contracts with Tetra Tech BAS, Inc., Anser Advisory Management, LLC, and Geosyntec Consultants, Inc. for On-Call Landfill Construction Support Services, effective January 26, 2024, through January 25, 2026, in an amount not to exceed $1,400,000 per contract, for an aggregate cumulative total amount not to exceed $9,450,000.

 

 

 

 

SUMMARY:

 

 

Approval of Amendment Number One to renew the contracts with Tetra Tech BAS, Inc., Anser Advisory Management, LLC, and Geosyntec Consultants, Inc. will provide specialized Landfill Construction Support Services and will support continued Countywide landfill operations and compliance with local, state and federal regulatory requirements.

 

 

BACKGROUND INFORMATION:

 

OC Waste & Recycling (OCWR) is responsible for managing the County of Orange’s (County) solid waste disposal system. The system consists of three active regional landfill operations, three organic processing facilities, 20 closed solid waste disposal sites and four household hazardous waste collection centers. The active regional landfills were opened to meet the solid waste management needs of the northern, central and southern regions of the County and consist of the Olinda Alpha Landfill, opened in 1960, to serve the northern region; Frank R. Bowerman Landfill, opened in 1990, to serve central region and Prima Deshecha Landfill, opened in 1976, to serve the southern region.

 

The Architect-Engineer (A-E) Services being requested will provide On-Call Landfill Construction Support Services (Services) such as Construction Management, Quality Assurance/Quality Control, Inspection, Surveying, Archaeological/Paleontological Monitoring, Biological Monitoring and other support services as required for various landfill projects to match staff and consultant expertise with current and future technical challenges. The Services include, but are not limited to, professional services, advice and consultation, contract administration, project planning, project implementation, project monitoring and controlling of construction projects, including scheduling and programming, integration of proposed project(s) with existing waste management operations, materials and systems, methods for achieving maximum value and control of schedule and cost, all of which are necessary to respond and comply with state and local regulatory requirements in a timely manner. These contracts will allow OCWR to make use of experts in a variety of different construction support disciplines allowing for solid waste and engineering support services during advertisement, preconstruction, construction and close-out phases.

 

Approval of Amendment Number One to renew contracts for A-E Services with Tetra Tech BAS, Inc., Anser Advisory Management, LLC, and Geosyntec Consultants, Inc. will continue to be used to assist the County in completing capital improvement, rehabilitation and maintenance projects. Many of the projects are time sensitive due to facilities reaching their useful life expectancy and needing repair and rehabilitation, while other projects are driven by safety, government code or regulatory permitting requirements. To continue the efficient operation and management of County landfill facilities, it is necessary to retain services to supplement staff and provide specialized expertise.

 

OCWR is requesting the Board of Supervisors (Board) approval of the following amendments to renew for the 4th and 5th year, effective January 26, 2024, through January 25, 2026, in an amount not to exceed $1.4 million per contract, for a revised aggregate contract total amount not to exceed $4.2 million:

Three-year contract for A-E On-Call Landfill Construction Support Services, January 26, 2021, through January 25, 2024, in an amount not to exceed $1,750,000 each, for a total cumulative amount not to exceed of $5,250,000, renewable for one additional two-year term.

 

 

The Contractor’s performance has been determined to be at least satisfactory. OCWR has verified there are no concerns that must be addressed with respect to the Contractor’s ownership/name, litigation status or conflicts with County interests.  Prior to contract expiration, OCWR plans to issue a solicitation to continue Services, per delegated authority from OC Public Works Director.

 

The contracts with Tetra Tech BAS, Inc., Anser Advisory Management, LLC, and Geosyntec Consultants, Inc. include subcontractors, all of which could require the addition of subcontractors. In order to add subcontractor(s) to a contract, the consultant must seek express consent from OCWR. Should the addition of a subcontractor affect the scope of work and/or contract amount, OCWR will bring the item back to the Board approval. See Attachments G, H and I for information regarding subconsultant and the Contract Summary Form(s).

 

In accordance with the 2020 Design and Construction Procurement Policy Manual (DCPM) Section 3.3-102(1) and Pursuant to Government Code Section 25502.5(a), approval by the Board is required for all A-E services contracts in excess of $200,000.

 

Compliance with CEQA: This action was previously determined to be not a project within the meaning of CEQA guidelines section 15378 on January 26, 2021, when it was originally approved. This action to approve an amendment to the contract is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project since the activity is award of a contract for consulting and support services only. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

 

 


 

 

FINANCIAL IMPACT:

 

Appropriations for these contracts are included in the FY 2023-24 Budget for OC Waste & Recycling Fund 299 and Fund 273 and will be included in the budgeting process for future years.

 

The proposed contracts include a provision stating the contracts are subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the terms of these contracts. The contracts contain language allowing for termination and language stating there is no guarantee given by the County regarding usage.
