RECOMMENDED

SUMMARY:
Approval of this non-financial
Memorandum of Understanding with the California Department of Child Support
Services will allow eligibility staff from the Social Services Agency continued
access to the Child Support Enforcement System to verify program eligibility
information and locate non-custodial parents.
BACKGROUND
INFORMATION:
The Social Services Agency (SSA) is
requesting the Board of Supervisors’ (Board) approval of this non-financial
Memorandum of Understanding (MOU) with the California Department of Child
Support Services (CDCSS) for the term of January 1, 2024, through December 31,
2026. This MOU will provide SSA with online access to the Child Support
Enforcement System (CSE) and the ability to continue to verify child support
payments for income purposes and determine the whereabouts of non-custodial
parents.
On December 8, 2020, the Board
approved the current non-financial MOU with CDCSS, for the term of January 1,
2021, through December 31, 2023. On December 12, 2017, the Board approved the
previous non-financial MOU with CDCSS, for the term of January 1, 2018, through
December 31, 2020.
SSA utilizes CSE for a variety of
purposes. Under state and federal law, applicants and recipients of the
California Work Opportunity and Responsibility to Kids (CalWORKs), Foster Care
and Medi-Cal programs must cooperate with CDCSS to identify and locate
non-custodial parents, assign child support rights to the County, establish
paternity and enforce child and medical support. SSA also uses CSE to determine
child support income for the purposes of CalFresh eligibility. Finally, CSE is
used to meet court-ordered requirements of finding and notifying individuals of
upcoming hearings. CSE is the only source available to verify required
eligibility information and approval of the MOU is essential for meeting state
and federal mandates.
SSA negotiated this non-financial
MOU without formal advertising in compliance with the California Department of
Social Services Purchase of Service Regulation 23-650.1.14 - Procurement by
Negotiation, which authorizes negotiating for any service rendered by a
federal, state or local government agency, public university, public college or
other public educational institution for an Agreement term up to three years.
This MOU, which does not contain
insurance or indemnification language, has been reviewed and deemed acceptable
by County Executive Office/Risk Management.
A copy of the Risk Assessment or Modification of Insurance Terms Form is
included as Attachment C to this Agenda Staff Report.
Subcontracts
The proposed MOU does not include
subcontractors or pass through agreements to other providers. See Attachment D
for the Contract Summary Form.
