RECOMMENDED ACTION(S):

 

 

1.

Approve recommendation to award the contract for the provision of Inmate Telephone Services to Global Tel*Link Corporation for a minimum annual revenue amount of $4,350,000.

 

2.

Authorize the Sheriff-Coroner (Sheriff) or designee to execute Agreement MA-060-15010542 with Global Tel*Link Corporation (G-Tel) for the provision of Inmate Telephone Services for a one-year period effective upon Board of Supervisors approval, with the option to renew for seven additional one-year terms, for a minimum annual revenue amount of $4,350,000.

 

 

 

 

SUMMARY:

 

Approval of the award recommendation and authorization for the Sheriff-Coroner (Sheriff) or her designee to execute the revenue agreement with G-Tel will allow the Sheriff's Department to provide telephone services for County inmates, detainees, and Probation Wards, and to generate revenue for the Inmate Welfare Fund and Ward Welfare Fund.

 

 

 

BACKGROUND INFORMATION:

 

The Orange County Jail System and Probation Department require telephone services for their inmates, detainees, and/or wards, and have historically contracted out for these services.  This is a revenue-generating contract for the Inmate and Ward Welfare Funds.  On November 19, 2013, the Board of Supervisors (Board) approved Amendment Number Twelve to Agreement MA-060-12011648 with G-Tel, extending the agreement for nine months, commencing on December 3, 2013 through September 2, 2014.  At that meeting, the Board amended the contract and directed that it should be extended, but on a "month-to-month" basis.  That amendment was duly accepted by a G-Tel representative present at the meeting and later ratified by G-Tel when a written amendment reflecting the month-to-month nature of the amendment was signed.  Also at the November 19, 2013 meeting, the Board directed that County Counsel provide advice to the Board regarding possible options in relation to this contract and recalendered the matter for a future date.  On January 14, 2014, the Sheriff's Department returned to the Board for direction on pursuing and obtaining a contract for services, at which time the Board directed the Sheriff’s Department to re-issue an RFP for inmate telephone services.  On April 8, 2014 the Sheriff returned to the Board to seek approval to release the Request for Proposals (RFP) on April, 9, 2014 and approval was granted.

 

The RFP was released, and five proposals were received on June 4, 2014.  The initial evaluation panel meeting was held on June 11, 2014 in which proposals were distributed to the evaluation panel members.  The subsequent panel meeting to score proposals was initially scheduled for July 23, 2014, but had to be rescheduled to August 6, 2014 for several reasons, including a higher than expected number of proposals having been received and requiring review, a panel member being subpoenaed for court cases, and conflicting schedules of panel members.  Due to the delay, on August 19, 2014, the Sheriff requested Board of Supervisors approval of Amendment Thirteen to Agreement Z1000000063 with G-Tel for the provision of Inmate Telephone Services, to extend the agreement for six months for the period of September 3, 2014 through March 2, 2015, for a minimum revenue amount of $1,300,000.  The Board of Supervisors approved the extension, and directed the Sheriff to return to the Board by October 21, 2014 with either the request for award approval or to provide a status report.  The five member evaluation panel met to evaluate the proposals.  The RFP was evaluated based on the criteria noted in the table below.

The Sheriff requests approval of the award recommendation of G-Tel and authorization for the Sheriff or her designee to execute the agreement with G-Tel, as noted in the Recommended Action. 

 

 

 

FINANCIAL IMPACT:

 

Revenue generated by the Inmate Telephone Services agreement is deposited into the Inmate Welfare Fund 144 and Ward Welfare Fund 14R.  Revenue for this agreement will be included in the Second Quarter Budget Adjustment Request, and will be included in the budgeting process for future years.  This agreement contains language allowing the Department to terminate the contract or reduce the level of services with or without cause and without penalty.
