RECOMMENDED ACTION(S):

 

 

1.

Approve for use, the Paternity Opportunity Program Master Agreement form in the aggregate amount of $650,000 for the period December 1, 2014 through November 30, 2019.

 

2.

Authorize the Department of Child Support Services Director, or designee, on behalf of the Board of Supervisors, to execute a Paternity Opportunity Program Agreement in the approved form, with each of the providers listed on page 3 of this Agenda Staff Report for the period of December 1, 2014 through November 30, 2019.

 

3.

Authorize the Department of Child Support Services Director, or designee, on behalf of the Board of Supervisors, to execute, during the period between December 1, 2014 and November 30, 2019, a Paternity Opportunity Program Agreement in the approved form, with any other provider in Orange County that qualifies to provide the services described in the Agreement.

         

 

 

 

 

SUMMARY:

 

Authorization and approval of Paternity Opportunity Program Master Agreement for the provision of Paternity Opportunity Program Services in order to establish paternity on out of wedlock births as mandated by California Family Code Sections 7571-7577.

 

 

 

BACKGROUND INFORMATION:

 

California Family Code Sections 7571-7577 require Local Child Support Agencies to enter into a written agreement with hospitals and other entities providing prenatal services and pay for costs incurred in the filing of voluntary declarations of paternity with the State Department of Child Support Services (DCSS). Additionally, the Plan of Cooperation between DCSS and the Orange County Department of Child Support Services (CSS) requires CSS to pay hospitals, clinics, or other places of birth all sums required by California Family Code Section 7571 for the filing of completed voluntary declarations of paternity.  California Family Code Section 7571 establishes the current rate of payment at ten dollars ($10) per completed declaration.  

 

In accordance with California Family Code Sections 7571-7577, effective January 1, 1995, the person responsible for registering live births under Section 102405 of the Health and Safety Code, must upon the event of a live birth provide to the natural mother and attempt to provide, at the place of birth, to the man identified by the natural mother as the natural father, a voluntary declaration of paternity and written materials and information about the legal effect of executing the voluntary declaration. Under the Paternity Opportunity Program, staff in hospitals, and other entities providing prenatal services must witness the signing of the voluntary declaration by parents, file the completed declaration with DCSS and provide a copy to the Local Child Support Agency.

 

The establishment of paternity is critical for children born out of wedlock as they are not afforded the same legal benefits as children for whom paternity has been established including establishment of support orders.  The state-wide Paternity Opportunity Program offers parents a simple and cost-effective alternative by which paternity can be established by voluntary declaration. The result is an increase in the number of children for whom paternity has been established, the establishment of expeditious support orders and subsequent enforcement, and the elimination or reduction in costs associated with lengthy and expensive court processes required for establishing paternity.

 

Costs paid by CSS for these services are included in the FY 2014-15 Adopted Budget and CSS plans to include in future budget processes. Payment of costs by CSS are 100% Federally and State funded and there is no net cost to County. 

 

On October 1, 2002, the Board approved the Master Agreement between Orange County Department of Child Support Services (CSS) for the various hospitals, clinics and birthing centers licensed to provide obstetric services, to file completed voluntary declarations of paternity with birth certificates and transmit copies to CSS for the period of October 1, 2002 through September 30, 2006.

 

On November 21, 2006, CSS returned to the Board and received approval for the  Paternity Opportunity Program Master Agreement, continuing the services for the period of December 1, 2006 through November 30, 2009, in the amount of $450,000.

 

On November 10, 2009, CSS returned to the Board and received approval for the Paternity Opportunity Program Master Agreement, continuing the services for the period of December 1, 2009 through November 30, 2014, in the amount of $750,000.

 

The following Orange County health care providers are currently cooperating in this program and under a current Agreement and are expected to continue providing services under the proposed Agreement:

Other qualifying health care providers may be identified and will be added to the program during the term of the Agreement, as requested in recommended action number 3.

 

As required by California Family Code Sections 7571-7577, the Department of Child Support Services is requesting your Honorable Board's authorization to execute the Paternity Opportunity Program Agreement with the various health care providers, in an amount not to exceed $650,000 for the period of December 1, 2014 through November 30, 2019, as referenced in the Recommended Actions.

 

 

 

FINANCIAL IMPACT:

 

Expense is budgeted by CSS utilizing existing appropriations funded by State and Federal revenues.

 

The agreement contains language, permitting reduction or termination without penalty if approved funding or appropriations are reduced or terminated.
