RECOMMENDED ACTION(S):

 

 

1.

Approve the Fifth Amendment to the Five-Year Agreement with the City of Stanton for law enforcement services effective October 5, 2021, to add one Crime Prevention Specialist position, one Office Specialist position and one Mobile Data Computer.

 

2.

Approve the FY 2021-22 charges for law enforcement services to the City of Stanton in an amount not to exceed $12,329,325, for a revised cumulative contract total amount not to exceed $46,318,114.

 

3.

Delegate to the Sheriff-Coroner authority to execute written amendments to the Five-Year Agreement that increase or decrease the total FY 2021-22 cost of service by 1 percent or less of $12,329,325 and that do not materially change other provisions of the agreement.

 

 

 

 

SUMMARY:

 

Approval of the Fifth Amendment to the Five-Year Agreement with the City of Stanton will allow the Sheriff-Coroner Department to continue to provide law enforcement services to maintain the safety and welfare of residents of the City of Stanton.

 

 

 

BACKGROUND INFORMATION:

 

The City of Stanton has been contracting with the County of Orange (County) for the Sheriff-Coroner Department (Sheriff) to provide law enforcement services since 1988.  The table below notes when the Board of Supervisors (Board) approved the most recent agreements, amendments and any annual adjustment amount.

Additionally, the Fifth Amendment adds the acquisition and recurring costs for one Mobile Data Computer. The total cost to the City of Stanton for FY 2021-22 is $12,329,325, which includes regional/shared staff.

 

Agreement costs include salaries, wages, employee benefits, services and supplies, transportation expenses, as well as division, department and County (County-Wide Cost Allocation Plan) overhead.  FY 2021-22 cost is 1.39 percent higher ($171,660) than the previous agreement of $12,157,665.  The net increase is due to updated salary and benefit changes approved by the Association of Orange County Deputy Sheriffs (AOCDS), Association of County Law Enforcement Managers (ACLEM), Orange County Managers Association (OCMA) and the Orange County Employees Association (OCEA).  The AOCDS agreement was approved by the Board on October 8, 2019.  The Board approved the ACLEM, OCMA and OCEA agreements on October 22, 2019.

 

This Fifth Amendment to the Agreement is submitted for approval less than 30 days before its effective date due to an extended negotiation period over the terms and conditions in the Amendment.  The Stanton City Council has approved this Amendment at its September 28, 2021, meeting.

 

 

FINANCIAL IMPACT:

 

The City of Stanton is responsible for 100 percent of the costs related to this Agreement.  Appropriations and Revenue for this Agreement are included in Budget Control 060, Sheriff-Coroner FY 2021-22 Budget.  Adjustment to reconcile positions with related appropriations and revenue to the adopted FY 2021-22 agreement will be requested in the FY 2021-22 Mid-Year Budget Report.
