RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Contract Amendment Number Two to renew Contract with Civil Environmental Survey Group Inc. dba CES for continuing operations and maintenance services of groundwater control and monitoring systems and water supply systems at the North Region Landfills for the fifth and final year, effective November 15, 2021, through November 14, 2022, in an amount not to exceed $350,000, for a revised cumulative Contract total not to exceed $1,750,000, with unused funds carried over from the fourth year.

 

 

 

SUMMARY:

 

Approval of Amendment Number Two to the Contract with Civil Environmental Survey Group Inc. dba CES to provide continuing operations and maintenance services of groundwater control and monitoring systems and water supply systems will support continued landfill operations and compliance with state and federal regulatory requirements at the North Region Landfills.

 

 

 

BACKGROUND INFORMATION:

 

OC Waste & Recycling (OCWR) is responsible for managing the County’s solid waste disposal system including North Region Landfills (North Region) that consist of the active Olinda Alpha Landfill and 10 closed solid waste disposal sites. The Olinda Alpha Landfill was opened in 1960 to meet the solid waste disposal needs of the northern portion of Orange County.

 

On October 31, 2017, as the result of an Invitation for Bids, the Board of Supervisors (Board) awarded Contract MA-299-18010447 (Contract) with Civil Environmental Survey Group Inc. dba CES (CES) to provide operations and maintenance services of groundwater control and monitoring systems and water supply systems at North Region Landfills for a three-year term, effective November 15, 2017, through November 14, 2020, in an amount not to exceed $1.05 million, renewable for two additional one-year terms not to exceed $350,000 each year, with excess funds to be carried over from year to year not to exceed the revised cumulative contract total. The Contract with CES provides operation and maintenance services of the leachate (liquid that drains from a landfill) groundwater extraction systems and all various liquid conveyance systems at North Region Landfills. Services by CES support continued landfill operations, including post-closure requirements. Under the Contract, CES provides the Olinda Alpha Landfill and North Region closed sites such services as maintenance and repair of the potable/non-potable water system; leachate collection and removal system; groundwater extraction system; and as-needed services to support compliance with regulatory requirements at the Olinda Alpha Landfill.

 

On October 6, 2020, Amendment Number One was approved by the Board to allow the Contract to be renewed for one year, effective November 15, 2020, through November 14, 2021, in an amount not to exceed $350,000 for a revised cumulative total not to exceed $1.4 million, renewable for one additional one-year term in an amount not to exceed $350,000 per year.  Amendment Number One also modified the Contract’s scope of work to address regulatory requirement changes to the site’s groundwater control and monitoring systems, water supply systems and associated stormwater management systems, and revised the Contract’s fee structure to account for the new and modified responsibilities. 

 

Approval of Amendment Number Two will renew the Contract for the fifth and final year, effective November 15, 2021, through November 14, 2022, in an amount not to exceed $350,000 for a revised cumulative total not to exceed $1.75 million.  This renewal allows CES to continue providing North Region operations and maintenance services of groundwater control, monitoring systems and water supply systems including maintenance and repair of the potable/non-potable water system, leachate collection and removal system, groundwater extraction system, general pump and groundwater monitoring well and as-needed services to support OCWR compliance with regulatory requirements. Prior to Contract expiration OCWR will issue a solicitation to procure a new contract for continuing groundwater control and monitoring services at North Region .

 

The Contractor's performance has been confirmed as at least satisfactory. OCWR has verified there are no concerns that must be addressed with respect to Contractor's ownership/name, litigation status or conflicts with County interests. The Orange County Preference Policy is not applicable to this Contract.

 

 

This Contract includes subcontractors. See Attachment C for information regarding subcontractors and Contract Summary Form.

 

Compliance with CEQA: On October 31, 2017, the Board found that the proposed action is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to Section 15301 of the CEQA Guidelines, since Class 1 (Existing Facilities) consists of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. In addition, the proposed action is also Categorically Exempt (Class 4) from the provisions of CEQA pursuant to Section 15304 of the CEQA Guidelines, since Class 4 (Minor Alterations to Land) involves minor alterations to land. Also, the proposed action is also Categorically Exempt (Class 7) from the provisions of CEQA pursuant to Section 15307 (Actions by Regulatory Agencies for Protection of Natural Resources), since Class 7 consists of actions taken by a public agency for the protection of natural resources. The proposed action is also Categorically Exempt (Class 8) from the provisions of CEQA pursuant to Section 15308 (Actions by Regulatory Agencies for Protection of the Environment), since Class 8 consists of actions taken by a public agency for the protection of the environment. This Contract will allow for the operation and maintenance of the groundwater control and monitoring systems at the Olinda Alpha Landfill and other North Region closed landfill sites which is consistent with a Class 1, Class 4, Class 7 and Class 8 Categorical Exemption determination.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract Amendment Number Two are included in the FY 2021-22 Budget for OC Waste & Recycling, Fund 299. The Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
