RECOMMENDED ACTION(S):

 

 

1.

Final EIR No. 604, previously certified by the Board of Supervisors on August 15, 2006, in combination with Addendums 604-3 and 604-9, reflect the independent judgment of the County of Orange and satisfy the requirements of CEQA for the proposed project, which is a necessarily included element contemplated as part of this action.

 

a.

The circumstances of the project are substantially the same as Final EIR 604, in combination with Addendums 604-3 and 604-9, which adequately addressed the effects of the proposed project.  No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken have occurred, and no new information of substantial importance to the project which was not known or could not have been known when the previous Final EIR No. 604, in combination with Addendums 604-3 and 604-9, were adopted has become known and no further environmental review is required.

 

b.

Final EIR No. 604, in combination with Addendums 604-3 and 604-9, are adequate to satisfy the requirements of CEQA for the East Flank and East Loma Landslide Remediation projects at the Frank R. Bowerman Landfill.

 

c.

All mitigation measures are fully enforceable pursuant to CEQA (Public Resources Code) Section 21081.6(b) and have either been adopted as conditions, incorporated as part of the project design, or included in the procedures of project implementation.

 

2.

Approve Amendment No.1 to Agreement MA-299-13010708 with Simplus Management Corporation to provide ongoing construction management, quality assurance/quality control, and archaeological/paleontological services for Central Region Landfills. This amendment will increase the Agreement amount by $988,100.18 for a revised total amount not to exceed $6,188,100.18. This amendment does not extend the contract expiration date of November 19, 2015.

 

3.

Authorize the Chairman of the Board to execute Amendment No. 1 to Agreement MA-299-13010708.

 

4.

OC Waste & Recycling shall provide a status report to the Board within eight months, regarding the status of the project and any associated impacts on future landfill development and long-term capacity.

 

 

 

 

 

 

SUMMARY:

 

Approval of Amendment No. 1 to Agreement MA-299-13010708 with Simplus Management Corporation in an amount not to exceed $988,100.18 to continue to provide construction management, quality assurance/quality control, and archaeological/paleontological services will support continued landfill operations and compliance with State and Federal regulatory requirements at Central Region Landfills.

 

 

 

BACKGROUND INFORMATION:

 

OC Waste & Recycling is responsible for managing the County’s solid waste disposal system including Central Region Landfills which consists of the active Frank R. Bowerman (FRB) Landfill, and five closed solid waste disposal sites. The FRB Landfill was opened in 1990 to meet the solid waste disposal needs of the central portion of Orange County.

 

OC Waste & Recycling is requesting approval of Amendment No. 1 to Agreement MA-299-13010708 with Simplus Management Corporation for an additional $988,100.18 in order to provide adequate construction management (CM) oversight of necessary landslide remediation activities to the East Flank Landslide Remediation Project at FRB.

 

On November 20, 2012, your Board approved Agreement MA-299-13010708 with Simplus Management Corporation for $5,200,000.  The intended scope of services for the contract included CM and QA/QC services for construction of public works projects at Central Region Landfills, including the East Flank Landslide Remediation Project.

 

In April 2014 an additional landslide (“East Loma Landslide”), estimated at a volume of 500,000 cubic yards, occurred within the East Flank Landslide Remediation Project area. The landslide was due to field conditions and extended into the public trail system within the OC Parks property boundary and beyond the interim grading permit for the East Flank Landslide Remediation Project. To mitigate this unanticipated East Loma Landslide, and stabilize the construction site and OC Parks trail system, the unstable material must be removed, graded, buttressed, and compacted to re-establish the slope and return the area to a safe condition. The East Loma Landslide remediation project must be completed to reinstate the public trail system and allow the current Contractor, Wood Bros., Inc., to continue with construction on the East Flank Landslide Remediation Project at Frank R. Bowerman Landfill which will provide for future landfill disposal. 

 

Amendment No. 1 to the Agreement with Simplus Management Corporation will provide continual CM, QA/QC, and A/P services during the landslide remediation activities including but not limited to: coordination, monitoring and control of construction activity; contract administration; control of schedule and cost; review remediation plans for completeness, compatibility, and constructability; chair weekly construction meetings; geological mapping and testing. 

 

On September 16, 2014, due to the additional landslide in the project area, your Board authorized additional geotechnical investigation and design support services for the East Flank Landslide Remediation Project and directed OC Waste & Recycling to report on the outcome within 8 months.  Work performed under the proposed amendment with Simplus Management group will be in accordance with the additional geotechnical investigation and design and will be included in the report.

 

Compliance with CEQA:  This project is a necessarily included element of the projects considered in Final EIR No. 604, certified by the Board of Supervisors on August 15, 2006, in combination with Addendums 604-3 and 604-9, which adequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken have occurred, and no new information of substantial importance to the project which was not known or could not have been known when Final EIR No. 604, in combination with Addendums 604-3 and 604-9, were certified has become known therefore no further environmental review is required.

 

 

 

FINANCIAL IMPACT:

 

OC Waste & Recycling will request $988,100.18 for this amendment through the County's First Quarter Budget Report.
