RECOMMENDED ACTION(S):

 

 

1.

Approve Amendment Number One to the Agreement to Transfer Funds for the 2020 Emergency Management Performance Grant Program COVID-19 Supplemental.

 

2.

Authorize the Sheriff-Coroner or his designee to execute, on behalf of the County of Orange, with each jurisdiction receiving grant funds the Amendment Number One to the Agreement to Transfer Funds for 2020 Emergency Management Performance Grant Program COVID-19 Supplemental.

 

3.

Authorize the Sheriff-Coroner or his designee to make non-substantive, administrative changes to the Agreement to Transfer Funds that are within County policy and conform to federal and state grant guidance in order to complete the grant.

 

 

 

 

SUMMARY:

 

Approval of Amendment Number One to the Agreement to Transfer Funds will allow the participating jurisdictions to complete their proposed projects for the COVID-19 Supplemental program and seek federal reimbursement through the County.  These activities contribute to Orange County's capability to prevent, prepare for, mitigate against, respond to and recover from natural or manmade emergencies and disasters.

 

 

 

BACKGROUND INFORMATION:

 

The U.S. Department of Homeland Security is administering the 2020 Emergency Management Performance Grant Supplemental (EMPG-S) Program nationally, and the California Office of Emergency Services (CalOES) is managing the grant for California.  Counties and Operational Areas are eligible to apply for this grant.  The purpose of the supplemental grant is to assist with activities relating to the ongoing COVID-19 public health emergency. 

 

The Sheriff-Coroner Department (Sheriff) received Board of Supervisors (Board) approval to apply for the 2020 EMPG-S funding on July 28, 2020. 

 

The FY 2020 EMPG-S program assists states, territories, tribes and local governments with their public health and emergency management activities supporting the prevention of, preparation for and response to COVID-19.

 

The current allocation includes a pass-through to Orange County cities.  These funds are distributed on a population basis to those cities who wish to apply and complete the required activities.  The match to pass-through funds will be provided by participating cities.

 

The Operational Area Executive Board reviewed the proposed application budget and required activities at their quarterly meeting on August 12, 2020.  CalOES approved the application on October 23, 2020.

 

On January 26, 2021, the Board accepted the grant award in the amount of $320,955, and approved the form Agreement to Transfer Funds for 2020 EMPG-S, authorized execution of related documents including agreements with each jurisdiction receiving grant funds and directed the Auditor-Controller to transfer grant funds to other entities upon receipt of executed agreements.

 

The original Agreement to Transfer Funds included a deadline of June 30, 2021, for participating jurisdictions to submit reimbursement requests.  Some participating jurisdictions were unable to complete their project expenditures within that timeframe due to extraordinary circumstances of pandemic, fires and civil unrest during the past year.  The County requested a grant extension from CalOES through December 27, 2021, which was approved; the final Request for Reimbursement from the County on behalf of the participating jurisdictions will be 20 calendar days thence (January 16, 2022).  The Recommended Action is to approve Amendment Number One, which will extend the deadline for participating jurisdictions to submit Reimbursement Requests to the County to December 31, 2021.  This will allow sufficient time for the County to assemble the final Reimbursement Request and submit it by the January 16, 2022, deadline.

 

 

 

FINANCIAL IMPACT:

 

The County's share of the FY 2020 EMPG-S is included in the Sheriff-Coroner's FY 2021-22 Budget for Budget Control 060 and adjustments to reconcile appropriations and revenue will be requested in the  FY 2021-22 Mid-Year Budget Report.  The grant requires a dollar for dollar match; the match amount for the Emergency Management Division budgeted allocation is $320,955.  The current Net County Cost allocation is sufficient to match the additional EMPG-S funding.
