SUMMARY:
Award of the construction contract for the Irvine Regional Park Falcon Flats Shade Structure Project will enhance the park visitor experience by constructing a large new shade structure.
BACKGROUND INFORMATION:
Irvine Regional Park (Park) is a 495-acre park located in the City of Orange that features the OC Zoo, a nature center, Irvine Park Railroad, pony rides, guided equestrian tours, a weekly farmers market, annual concerts and movie nights and yearly themed events such as the annual Irvine Park Railroad Pumpkin Patch and Christmas Train. Founded on land donated by James Irvine II in 1897, this Park is the oldest regional park in California and hosts over one million annual visitors who enjoy the numerous family friendly amenities and activities.
The Park features several small picnic areas and four large reservable group areas. The Falcon Flats group area (Falcon Flats) is the largest reservable group area, which accommodates groups up to 300 people and experiences heavy use. Park visitors use Falcon Flats on a daily basis for a variety of uses including birthday parties, family reunions, school functions, company picnics and 5-kilometer running events. Falcon Flats, located in a large turf grass area void of shade trees and vegetation, is the only reservable group area in the Park that does not have a shade structure or access to electrical power. In addition, the area has seen a reduction of tree canopy due to beetle infestation. Adding a new shade structure with power outlets at Falcon Flats would greatly enhance the park visitor experience by providing more protection from the sun and adequate shade from extreme summer heat.
On November 8, 2019, OC Public Works negotiated a contract with DKY Architects, dba Streshinsky Architectural Corporation, to develop plans and specifications for the Park Falcon Flats Shade Structure Project (Project). The design provides for the construction of a large shade structure with a concrete pad, a food preparation counter and an Americans with Disabilities Act-compliant path of travel to a parking lot near the Falcon Flats group area of the park. Two electrical outlets and three barbeque grills will also be installed in the new shade structure. The new structure will match the aesthetics and materials used in existing buildings within the Park. The shade structure will be constructed of steel and fire-treated structural lumber, red clay Spanish roof tile and river rock stone veneer on the support columns.
On May 26, 2021, OC Public Works issued Pre-Qualification documents through the County of Orange (County) online bidding system. Nine contractors submitted Statements of Qualifications and were pre-qualified and allowed to submit proposals in response to the County’s subsequent Invitation for Bid (IFB). On June 16, 2021, OC Public Works issued an IFB to the nine pre-qualified contractors for the Project. On July 7, 2021, OC Public Works received five bids; all were deemed responsive.

The lowest responsive and responsible bid submitted by SJD&B, Inc. (Contractor) for this Project is approximately 2.25 percent above the EE of $573,217. The Project has special requirements for metals fabrication and/or repair with fluctuating costs due to changes in material, delivery and labor costs caused by the current market conditions resulting from the COVID-19 pandemic. OC Public Works has reviewed the bids submitted and verified that the differences are not the result of errors or omissions.
OC Public Works is procuring services for this Project in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 4.4-102. The Orange County Preference Policy is not applicable to this contract award. A full summary of the five responsive bids received can be found in the Bid Summary as Attachment B.
OC Public Works is recommending the Board of Supervisors (Board) approve Contract CT-012-22010055 (Contract) with the Contractor, in an amount of $586,110, effective September 28, 2021, to be completed within 150 calendar days of the effective date of the Notice to Proceed.
The Contractor's license number was verified as current and active through the Contractors State License Board database on June 10, 2021. A copy of the verification is on file.
OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with San Bernardino County, Los Angeles County and Tilden-Coil Constructors, Inc. regarding similar projects.
This Contract includes subcontractors. See Attachment C for information regarding subcontractors and Contract Summary Form.
This Contract is being presented for Board consideration less than 30 days before the effective date due to additional negotiation time required with the Contractor after the bid opening date of July 7, 2021.
Compliance with CEQA: The proposed Project is Categorically Exempt (Class 1, 3, 4 and 11) from the provisions of CEQA pursuant to Sections 15301, 15303, 15304 and 15311) because it provides for minor alterations of existing facilities, involving no expansion of an existing use (Class 1), new construction (Class 3), minor alterations to land (Class 4) and accessory structures (Class 11).
FINANCIAL IMPACT:
Appropriations for this Contract are included in the FY 2021-22 Budget for OC Parks, Fund 406.
The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the Contract. If such appropriations are not approved, the Contract may be immediately terminated without penalty to the County.
