SUMMARY:
Award of the contract for the Arden Modjeska Stone House Restoration will improve the site and historic building structure, including providing a new staircase for second floor access and an Americans with Disabilities Act-compliant pathway to enhance public guided tours.
BACKGROUND INFORMATION:
The Helena Modjeska House and Garden (Arden) located at 29042 Modjeska Canyon Road, Silverado Canyon is a 14.4-acre estate containing the Modjeska Residence, several other structures, gardens with exotic and historically significant landscaping, fountains and pool, oak woodlands, native plants and wildlife. The greatest historical significance of the site is that it served as the former home of the celebrated nineteenth century actress Madame Helena Modjeska from 1888 to 1906. As part of the National Park Service’s (NPS) National Historic Landmark (NHL) Women’s History Initiative in 2012, Arden was listed as one of only seven Women’s History Sites in the Pacific West Region. Arden is one of the two NHLs in Orange County, California, the other being the Richard Nixon Presidential Library and Museum, located in Yorba Linda.
The Joseph Pleasants Stone Building (Stone Building) is the oldest building at Arden. The upper wood-framed portion of the Stone Building consists of an open room measuring approximately 22-foot-long by 15-foot-wide, which sits atop a first-floor stone cellar. OC Community Resources/OC Parks (OC Parks) began restoration of the Stone Building with the first-floor stone level, which was restored in 2007. While a significant investment was made to repair and restore the first-floor stone cellar, restoration of the second floor of the Stone Building has not been completed and currently exists in an overall poor condition. The second floor is currently encapsulated under a heavy-duty tarp preventing further moisture intrusion and deterioration of wood framing and interior features.
The Arden Modjeska Stone House Restoration (Project) consists of the second phase restoration of the Stone Building. The scope of work for the Project includes, but is not limited to, the following: treat and repair or, if necessary, replace “in kind” all damaged/deteriorated wooden material, including wood framing, wood subfloor, wood roof sheathing; install new waterproof membrane at roof and exterior walls and a new fire-retardant wood shingle roof; repair and restore wood windows and doors; construct new concrete footings and wood stairs to provide access to the second floor of the building. Once restoration of the building is complete, OC Parks will include the building as part of docent-led tours available at Arden. The Project also includes Americans with Disabilities Act-compliant site and pathway upgrades, as well as installation of electrical wiring, which will prepare the Stone Building to receive power at a later date.
OC Public Works negotiated a contract with Thirtieth Street Historic Restoration Architects to develop plans and specifications for the restoration of the Stone Building.
On June 1, 2022, OC Public Works issued Pre-Qualification documents through the County of Orange (County) online bidding system. One contractor responded and was pre-qualified to submit a proposal in response to the County’s subsequent Invitation for Bid (IFB).
On June 23, 2022, OC Public Works issued an IFB to the pre-qualified contractor for the Project. The following summarizes the responsive bid and provides a comparison against the Engineer’s Estimate (EE):

The lowest responsive and responsible bid submitted by K.C. Restoration Co., Inc. (Contractor) for this Project is approximately three percent above the EE of $972,386. OC Public Works has reviewed the bid submitted by the Contractor and verified that the difference is not the result of errors or omissions in the estimate.
OC Public Works is procuring construction services for this Project in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 4. The Orange County Preference Policy is not applicable to this contract award.
OC Public Works is recommending the Board of Supervisors (Board) award Contract CT-012-23010067 (Contract) with the Contractor for the Project in the amount of $1,000,768, to be completed within 200 calendar days of the effective date of the Notice to Proceed.
Upon award of the Contract by the Board and after receipt of all required documents by OC Public Works, the Director of OC Public Works or designee will execute the Contract and the Project Manager will issue the Notice to Proceed.
The Contractor’s license number was verified as current and active through the Contractors State License Board database on July 13, 2022. A copy of the verification is on file.
OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with City of Los Angeles, University of Southern California and Union Station Los Angeles regarding similar projects.
This Contract includes subcontractors. See Attachment B for information regarding subcontractors and the Contract Summary Form.
Compliance with CEQA: The proposed Project is Categorically Exempt (Class 31) from the provisions of CEQA pursuant to CEQA Guidelines Section 15331, because the Project is limited to maintenance, repair, rehabilitation, restoration and preservation of historical resources in a manner consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring and Reconstructing Historic Buildings.
FINANCIAL IMPACT:
Appropriations for this Contract are included in the FY 2022-23 Budget for OC Parks, Fund 406.
In 2017, OC Parks received an NPS Historic Preservation Fund Save America’s Treasures grant, in the amount of $153,016, to reimburse a portion of this Project (Grant Number, P18AP004130413).
The proposed Contract includes a provision, as found within the General Conditions of the Invitation for Bids, stating that this Contract may be terminated for convenience of the County upon not less than 30 days written notice to the Contractor without penalty to the County.
