RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Lenco Industries, Inc. contract for the one-time purchase and delivery of one armored vehicle, effective upon Board of Supervisors approval, in an amount not to exceed $406,470.63.

 

 

 

SUMMARY:

 

Approval of Lenco Industries, Inc. contract for the one-time purchase of one armored vehicle will allow the Sheriff-Coroner Department to ensure that its Special Weapons and Tactic team has the equipment necessary to provide for the safety of its personnel when protecting the community.

 

 

BACKGROUND INFORMATION:

 

The Sheriff-Coroner Department (Sheriff) is responsible for the safety of Orange County's three million residents.  The Sheriff's Special Weapons and Tactics (SWAT) team provides support to not only Sheriff's deputies, but also to city law enforcement within Orange County.  Sheriff purchased a large armored vehicle (also known as "the Bear") in 2005, which was approved by the Board of Supervisors (Board) as part of the FY04 Urban Areas Security Initiative grant funding on October 26, 2004.  The Bear provides cover for personnel in dangerous situations, and allows the Sheriff to provide critical support to its personnel and to other city law enforcement.  The Bear has reached the end of its useful life span, and is in need of replacement.  Sheriff's staff issued a Request for Bid for a replacement armored vehicle in May 2018.  Three bids were received, and Lenco Industries, Inc. was deemed to be the most responsive, responsible bidder (see Attachment B for Bid Recap form).  Sheriff's staff have conducted due diligence on the vendor.  Reference checks were satisfactory and completed with Santa Barbara Sheriff’s Department, California Highway Patrol and Contra Costa County Sheriff’s Department regarding similar purchases.

 

The new armored vehicle (also known as the BearCat) has been in use by many SWAT units across the U.S.  The BearCat has an all steel armor construction, V-8 turbo diesel engine and high ballistic protection.  It seats 10-12 officers and has an open floor plan to allow for rescue of downed personnel.  The BearCat also offers increased ground clearance and an adequate suspension for emergency response in rural regions and natural disaster scenarios where standard armored SWAT vehicles might experience challenges.

 

The proposed contract includes a limitation of liability, so Sheriff's staff negotiated an increase in insurance coverage.  The County is covered by insurance of $10 million in the event of death, bodily injury or property damage.  The limitation of liability shall not apply to any liability under the General Terms and Conditions entitled "Compliance with Laws;" liability under the General Terms and Conditions entitled "Patent/Copyright Materials/Proprietary Infringement" or any other liability (including without limitation indemnification obligations) for infringement of third party intellectual property rights; claims arising under the General Terms and Conditions entitled "Indemnification" and "Confidentiality;" and attorney's fees that the County becomes entitled to recover as a prevailing party in any action.

 

The Sheriff requests Board approval of the proposed contract with Lenco Industries, Inc. for a one-time purchase of one armored vehicle in support of its SWAT team, in the amount of $406,470.63. This contract does not include subcontractors or pass through to other providers.  See Attachment C for the Contract Summary Form.

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff-Coroner’s FY 2018-19 Budget for Budget Control 060 (please see FY 2018-19 Equipment Detail sequence number 87).  This contract contains language allowing the Sheriff-Coroner Department to terminate the contract or reduce the level of services without penalty with cause or without cause in the event that funding is reduced and/or not available to continue funding the contract.
