RECOMMENDED ACTION(S):

Authorize the County Procurement Officer or Deputized designee to execute Amendment Number Six with All City Management Services, Inc,. to renew contract for the provision of crossing guard services, for the term of November 1, 2022, through October 31, 2023, in the not to exceed amount of $937,834 for a total contract amount not to exceed $4,431,117. |

Pursuant to County Contract Policy Manual Section 3.3-113, authorize the County Procurement Officer or Deputized designee to exercise a contingency contract cost increase, not to exceed a total of 10 percent of the contract amount for the first year of the contract, for use over the entire term of the contract, including renewals, and within the scope of work set for in the contract. The use of this contingency contract cost increase is subject to approval requirements established by the County Procurement Officer. |
SUMMARY:
Approval of Amendment Number Six to the All City Management Services, Inc. contract will allow the Sheriff-Coroner Department to continue to provide crossing guards, as recommended by the Orange County Traffic Committee, to protect children as they walk to and from school in high-traffic unincorporated areas.
BACKGROUND INFORMATION:
Based on case law, California Attorney General opinions and California Vehicle Code Section 42201, counties have the discretion when deemed necessary and appropriate under California regulatory and statutory requirements and recommended by the Orange County (OC) Traffic Committee to provide crossing guards for schools in unincorporated areas. The Sheriff-Coroner Department (Sheriff) provides crossing guard services at intersections in unincorporated areas that school districts have identified as places where children need crossing assistance. School district requests for crossing guards are reviewed by the OC Traffic Committee. If it is determined that the request meets the requirements for a crossing guard, the OC Traffic Committee makes a recommendation to the Board of Supervisors (Board) for approval of a crossing guard at the location requested. If the Board approves the recommendation, the Sheriff is directed to establish a crossing guard. The Sheriff currently has 64 contracted crossing guard locations.
The Sheriff contracts out for this service to ensure adequate coverage at all approved crossing guard locations. The following table details the recent contract history for crossing guard services.

Contract increase of $675,000 was necessary in order to provide appropriate crossing guard coverage in conjunction with COVID-19 hybrid school schedules (due to social distancing requirements) and the continued uncertainty of school schedules due to COVID-19. |
Contractor performance has been confirmed as at least satisfactory. Sheriff has verified that there are no concerns that must be addressed with respect to contractors' ownership/name, litigation status of conflicts with County interests. The Orange County Preference Policy is not applicable to this contract amendment.
Sheriff requests Board approval for Amendment Six to the All City Management Services, Inc., contract for the one-year term of November 1, 2022, through and including October 31, 2023, in the amount of $937,834, for a new contract total not-to-exceed amount of $4,431,117. Sheriff also requests to continue the 10 percent contingency clause in the event additional crossing guard shifts or hours are needed in order to provide appropriate coverage in conjunction with hybrid school schedules due to social distancing requirements, or the OC Traffic Committee recommends additional crossing guards during the contract term. Note that current contract year cost and the increased contract cost for FY 2022-23 reflects the California mandated minimum wage increase. This contract does not currently include subcontractors or pass through to other providers. See Attachment D for the Contract Summary Form.
FINANCIAL IMPACT:
Appropriations for this contract are included in Sheriff-Coroner's Budget Control 060 FY 2022-23 Budget and will be included in the budgeting process in future years. The contract contains language allowing the Sheriff-Coroner Department to terminate the contract without penalty with cause or after 30 days of written notice without cause in the event that funding is reduced and/or not available to continue funding the contract.
