RECOMMENDED ACTION(S):

 

 

1.

Find that Addendum IP 09-048 to Final EIR 542, previously certified by the Board of Supervisors on September 15, 2009, reflects the independent judgment of the County of Orange and satisfies the requirements of CEQA for Moulton Parkway Widening (Segment 3 Phase II), which is a necessarily included element contemplated as part of the larger action.

 

 

a.   The circumstances of the project are substantially the same and Addendum IP 09-048 to Final EIR 542 adequately addressed the effects of the proposed project.  No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken, and no new information of substantial importance to the project which was not known or could not have been known when the previous Addendum IP 09-048 to Final EIR 542 was adopted has become known and no further environmental review is required.

 

 

b.    Addendum IP 09-048 to Final EIR 542 is adequate to satisfy the requirements of CEQA for  Moulton Parkway Widening (Segment 3 Phase II).

 

 

c.      All mitigation measures are fully enforceable pursuant to CEQA (Public Resources Code) Section 21081.6(b) and have either been adopted as conditions, incorporated as part of the project design, or included in the procedures of project implementation.

 

2.

Approve Notice to Contractors, form of Proposal, form of Construction Agreement, and Special Provisions and Plans for the Moulton Parkway Widening (Segment 3, Phase II) Project.

 

3.

Adopt a Resolution declaring portions of Moulton Parkway from 400 feet north of El Toro Road to 500 feet north of Santa Maria Avenue within the city of Laguna Woods to be a County highway for construction purposes.

 

4.

Approve the Pre-qualified List of Contractors to bid on the Moulton Parkway Widening (Segment 3, Phase II) Project.

 

5.

Authorize OC Public Works to solicit bids from the Pre-qualified List of Contractors for the Moulton Parkway Widening (Segment 3, Phase II) Project and set 2:00 p.m., Wednesday, October 10, 2012 as the time and date for bid opening.

 

 

 

 

SUMMARY:

 

Approval of the Moulton Parkway Widening (Segment 3, Phase II) Project documents will support improved traffic movement and safety, provide safe pedestrian and bicycle access, and facilitate public transit within the project limits.

 

 

 

BACKGROUND INFORMATION:

 

The County, on behalf of the city of Laguna Woods, has prepared the design of the Moulton Parkway Widening (Segment 3, Phase II) Project, from 400 feet north of El Toro Road to 500 feet north of Santa Maria Avenue in the city of Laguna Woods.  The project will widen and upgrade a 4,220 foot segment of Moulton Parkway to a 6-lane Smart Street in conformance with its designation on the Orange County Transportation Authority's Master Plan of Arterial Highways.  This Project is the last segment of the Moulton Parkway Smart Street Project, which extends 24.5 miles from the city of Santa Ana to the city of Dana Point.

 

The project scope includes road widening, continuous sidewalk and bike lanes, traffic signal synchronization, bus turnouts, intersection improvements, new dedicated right turn lanes into the adjacent golf course and garden center, and increased capacity for existing dedicated left turn lanes at Gate 12 and Santa Maria.

 

In 2001 and 2005, your Board approved agreements No. D99-100 and D03-071 with the City of Laguna Woods for design, right-of-way acquisition, and construction services for the Moulton Parkway Widening Project between Via Campo Verde and Ridge Route Drive (Segments 2 and 3).  On June 23, 2009, your Board approved the construction of Moulton Parkway Segment 2 from Santa Maria Avenue to El Pacifico Drive.  On September 15, 2009, your Board approved the construction of Moulton Parkway Segment 3, Phase I from 300 feet South of Via Campo Verde to 1200 feet North of El Toro Road.  This project was completed on April 27, 2012.

 

A resolution is required to declare portions of Moulton Parkway, from 400 feet north of El Toro Road to 500 feet north of Santa Maria Avenue, within the city of Laguna Woods to be a County highway for construction purposes.  A 4/5 majority vote is required from your Board in order to declare a city street to be a County highway for construction purposes.  The Resolution states "that upon the filing of a Notice of Completion that all improvements to City's Street(s) are complete, the board of Supervisors hereby declares City's Street(s) to no longer be a County highway, and instructs OC Public Works to file copies of this Resolution and the Notice of Completion with the City Clerk.  Ten days after said filing, City's Street(s) shall cease to be a County highway."  Ownership and maintenance will revert back to the City of Laguna Woods upon completion of the project.

 

A copy of the Plans and Special Provisions is on file at the office of the Clerk of the Board.

 

Pre-Qualified List of Contractors

In an effort to deliver quality projects on time and within budget, OC Public Works is implementing a Bidder Pre-Qualification Program (Program) to attract the most experienced, responsible and responsive contractors.

 

The Program evaluates contractors based on a variety of topics including, but not limited to: (i) the contractor’s experience, competency, capability, and capacity to complete projects of similar size, scope and complexity; (ii) experience and training of key personnel; (iii) financial capacity to complete the project; (iv) licenses, registration, and credentials; (v) bonding capacity; and (vi) past performance. 

 

Starting on May 22, 2012, and ending on June 27, 2012, OC Public Works publicly advertised a Request for Qualifications to pre-qualify General Contractors to be eligible to participate in the bidding process for the Moulton Parkway Widening (Segment 3 Phase II) Project.  Submittals were received from 10 contractors.  All 10 contractors were deemed qualified to bid on this project.

The contractors were notified of OC Public Works’ decision regarding prequalification results.  None have objected.

 

Compliance with CEQA: This project is a necessarily included element of the projects considered in Addendum IP 09-048 to Final EIR 542, certified by the Board of Supervisors on September 15, 2009, which adequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when the Addendum IP 09-048 to Final EIR 542 was certified has become known therefore no further environmental review is required.
