RECOMMENDED ACTION(S):

 

Consider and adopt a Resolution approving Amendment No. 3 to the 2001 Prima Deshecha Landfill General Development Plan.

 

 

 

 

SUMMARY:

 

Adoption of the Resolution will update the 2001 Prima Deshecha Landfill General Development Plan to be consistent with the Orange County Master Plan of Arterial Highways and Orange County General Plan Amendment to incorporate the Los Patrones Parkway Extension Project proposed alignment through the Prima Deshecha Landfill.

 

 

 

BACKGROUND INFORMATION:

 

OC Waste & Recycling (OCWR) is responsible for managing the Orange County solid waste disposal system including South Region Landfills that consist of the active Prima Deshecha Landfill (PDL) and five closed solid waste disposal sites. PDL was opened in 1976 to meet the solid waste disposal needs of the southern portion of Orange County. PDL is a 1,530-acre landfill site located within unincorporated Orange County, the City of San Juan Capistrano and the City of San Clemente. The landfill is operated by OCWR and has been in operation since 1976. The anticipated closure date for the landfill is in 2102. The landfill operation is currently located in an area designated as Zone 1, which has capacity to accept trash through approximately 2050. Zone 4, located on the east side of the property, is currently in the planning stages for development. Development of Zone 4 provides estimated disposal capacity for PDL through the year 2102, ensures long term disposal capacity for Orange County and provides a stable rate structure for the cities and special districts within the County for future generations.   

 

On November 6, 2001, the Board of Supervisors (Board) adopted the 2001 PDL General Development Plan (GDP), which is the planning document guiding the landfill’s development through projected closure of the landfill in 2102. Concurrently, the Board certified Final Environmental Impact Report (FEIR) No. 575, which analyzed the environmental impacts of the PDL GDP. The Board adopted Amendment Numbers One and Two to the PDL GDP on October 22, 2002, and June 19, 2007, respectively. Concurrently, with approval of Amendment Number Two, the Board certified Final Supplemental EIR (FSEIR) No. 597, which analyzed the environmental impacts of Amendment Number Two to the PDL GDP. These prior Board actions are described in greater detail in the table below.

 

On January 12, 2021, the Board adopted General Plan Amendment T20-02 – Transportation Element, which updated the County of Orange Circulation Plan (Plan) to be consistent with the Orange County Master Plan of Arterial Highways (MPAH). This Amendment deleted the “Conceptual Proposed” Cristianitos Road, south of Cow Camp Road, added to the Plan the alignment of the Los Patrones Parkway Extension (LPPE) from Cow Camp Road to Avenida La Pata (La Pata) and designated it a Primary Arterial Highway.

 

The conceptual alignment depicted on the Plan would traverse a portion of the PDL property, requiring an amendment to the PDL GDP. Concurrently, the Board certified the LPPE Addendum to FEIR No. 575 for the Prima Deshecha GDP, FEIR No. 584 for the Natural Communities Conservation Plan/Master Streambed Alteration Agreement/Habitat Conservation Plan for the Southern Subregion of Orange County and FEIR No. 589 for the Ranch Plan, which analyzed the environmental impacts associated with the LPPE and concluded that the proposed alignment would not result in a new significant impact on the environment beyond those analyzed in these FEIRs.

Approved Amendment Number One to the PDL GDP for the Settlement Agreement with the Rancho Mission Viejo Company (RMV), which revised Deed Restrictions for a portion of the landfill property resulting in minor adjustments to the proposed refuse footprint in Zone 4 for future landfilling activities in order to address comments by RMV on EIR No. 575 related to impacts of landfill activity on RMV’s anticipated future use of its adjacent property to the landfill. Because the refuse footprint was actually reduced and the elevation of refuse was unchanged, no additional environmental impacts resulted from the change to the PDL GDP.

June 19, 2007

Amendment No. 2 to PDL GDP and FSEIR No. 597

Approved Amendment Number Two to the GDP, which refined the GDP to include: (1) a more detailed assessment of project activities and requirements at the landfill; (2) modified drainage features to support on-site biological resources; (3) revised project design to improve drainage and avoid sensitive biological resources; (4) increased area of temporary ground disturbance to implement landslide remediation and landfill support features; and (5) incorporated pre-mitigation and biological enhancement plans to support the acquisition of long-term resource agency permits for continued landfill build-out. Also certified FSEIR No. 597 which analyzed the environmental impacts of Amendment Two to the GDP.

January 12, 2021

County General Plan Amendment T20-02 – Transportation Element and LPPE Addendum to FEIR No. 575, FEIR No. 584, and FEIR No. 589

Approved which updated the Plan to be consistent with the Orange County MPAH, including (1) deletion of the “Conceptual Proposed” Cristianitos Road, south of Cow Camp Road and (2) addition to the Plan the alignment of LPPE from Cow Camp Road to La Pata and designation of LPPE as a Primary Arterial Highway. Also certified the Addendum to FEIR No. 575, FEIR No. 584, and FEIR No. 589, which analyzed the environmental impacts of the proposed LPPE alignment.

 

 

Amendment Number Three to the PDL GDP (Attachment B) updates the Landfill, Circulation and Recreation Components of the PDL GDP to incorporate the analysis presented in the LPPE Addendum to FEIR No. 575, FEIR No. 584 and FEIR No. 589 and to be consistent with the MPAH and Plan. Changes to each component as outlined in the Addendum are summarized below.

 

At this time, the proposed LPPE alignment is conceptual. Prior to construction of LPPE, design-level engineering will be required to further refine the conceptual alignment. Upon completion of design-level engineering, further associated refinements will be made to the PDL design-level engineering plans in Zone 4 to incorporate the LPPE alignment through the landfill property; however, the conceptual alignment has been incorporated into the GDP.

 

Landfill Component – The proposed LPPE alignment would modify the southern boundary of Zone 4 of the landfill, reducing the area of Zone 4 by approximately 3.05 acres and the capacity for refuse disposal by approximately 300,000 to 600,000 cubic yards. The alignment would require a reconfiguration of the planned detention/desilting basins in the southern portion of Zone 4. The precise location of the relocated basins would be determined based on revisions to the landfill engineering plans that factors in the sequencing of the fill operations for Zone 4 to capture the maximum amount of drainage for the landfill area. Precise modifications to the Zone 4 landfill design plans will be initiated upon completion of design-level engineering for the LPPE alignment.

 

Circulation Component – The LPPE has been proposed to extend from its current terminus at Cow Camp Road south to La Pata to accommodate the north-south travel. The conceptual alignment would traverse the Ranch Plan Planned Community and a portion of the PDL property. Overall, the LPPE alignment as presented in the Transportation Element Amendment 20-2 and Revised Addendum to FEIR No. 575, FEIR No. 584 and FEIR No. 589 would cross through less than one percent of the PDL’s 1,530-acre site.

 

Recreation Component – This component depicts alignments for regional and local riding and hiking trails throughout the site in areas designated as Zone 2. Although some sections of these trails have been constructed, the majority are not yet built. For the majority of these trails, final alignments have not yet been determined, and will not be determined until post-closure of the landfill. Once Zone 4 is completed, the trail alignments can be developed and integrated into the ultimate recreation plan for the regional park. The proposed LPPE is conceptually shown as extending through a portion of Zone 2, adjacent to Zone 4, which is also an area identified for future park development, post-closure of the landfill. Given the expected timing of the trail is not until after 2102, the LPPE would not preclude the future implementation of the trail or the future park.

 

Natural Open Space - Construction of the proposed LPPE would result in permanent and restorable impacts in the Prima Deshecha Supplemental Open Space (SOS) as designated through participation in the Orange County Southern Sub-Region Habitat Conservation Plan (SSHCP). In compliance with the SSHCP, restoration of all impacts to SOS mitigation areas and conserved vegetation communities would be conducted. All impacted habitat mitigation areas would be recreated in either non-impacted SOS lands or within the Habitat Reserve. In addition, a portion of a viewshed planting area will be impacted by the proposed LPPE alignment along the ridgeline between Zones 3 and 4. Design and construction of the LPPE alignment will require coordination with the City of San Clemente to replace impacted viewshed plantings and to develop landscaping and additional viewshed protection measures appropriate to the changed ridgeline with the proposed roadway alignment.

 

Compliance with CEQA: This project is a necessarily included element of the project considered in Final EIR No. 575 for the 2001 Prima Deshecha General Development Plan, certified by the Board on November 6, 2001, in combination with the LPPE Addendum to Final EIR No. 575, Final EIR No. 584 and Final EIR No. 589 certified by the Board on January 12, 2021, which adequately addressed the effects of the proposed LPPE. Together, Final EIR No. 575 and the LPPE Addendum to Final EIR No. 575, Final EIR No. 584 and Final EIR No. 589 adequately address the effects of the proposed Project. No substantial changes have been made in the project, no substantial changes have occurred in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when Final EIR No. 575, in combination with the LPPE Addendum to Final EIR No. 575, Final EIR No. 584 and Final EIR No. 589, was certified and the Mitigation Monitoring and Reporting program was adopted have become known; therefore no further environmental review is required. The LPPE Addendum to Final EIR No. 575, Final EIR No. 584 and Final EIR 589, is attached to this ASR (Attachment C).
