RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Amendment Number Three to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories, for the term of October 17, 2021, through October 16, 2022, in an amount not to exceed $90,941, for a revised cumulative contract total amount not to exceed $507,855.

 

 

 

 

SUMMARY:

 

Approval of Amendment Number Three to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories will allow the Sheriff-Coroner Department to continue to support its Portable Evidential Breath Alcohol Testing Program to assist in maintaining safe driving and boating environments.

 

 

 

BACKGROUND INFORMATION:

 

The Sheriff-Coroner Department (Sheriff) employs a Portable Evidential Breath Testing program to test potential alcohol-impaired drivers.  California regulations require that the Forensic Alcohol Laboratory be responsible for the breath instrumentation used within its jurisdiction.  The items supplied by Intoximeters Inc. are needed for use with the instruments for the Portable Evidential Breath Testing program.  These instruments are manufactured by Intoximeters Inc. to individual customer's specifications; Intoximeters Inc. is the sole proprietor of these specific instruments and software.  The proposed contract is a sole source contract, and a completed Sole Source Request Form is attached to this Agenda Staff Report (Attachment C).

On October 17, 2017, the Board of Supervisors (Board) approved a sole source contract with Intoximeters Inc., for the two-year term of October 22, 2017, through October 21, 2019, in the not to exceed amount of $209,982.  Additionally, on September 24, 2019, the Board approved Amendment Number One to the sole source contract with Intoximeters Inc., for a one-year term of October 17, 2019, through October 16, 2020, in the not to exceed amount of $104,991.  Additionally, on November 17, 2020, the Board approved Amendment Number Two to the sole source contract with Intoximeters Inc., for a one-year term of October 17, 2020, through October 16, 2021, in an amount not to exceed $101,941 for a total cumulative contract amount not to exceed $416,914.

Contractor performance has been confirmed as at least satisfactory.  Sheriff has verified that there are no concerns that must be addressed with respect to contractor's ownership/name, litigation status or conflicts with County interests. 

Sheriff now requests Board approval for the County Procurement Officer or authorized Deputy to execute Amendment Number Three to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories, for the term of October 17, 2021, through October 16, 2022, in an amount not to exceed $90,941, for a revised cumulative contract total amount not to exceed $507,855.  This is the final term of the sole source contract, Sheriff intends to issue a solicitation to continue services prior to the contract's expiration.  This contract does not currently include subcontractors or pass through to other providers.  See Attachment D for the Contract Summary Form.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff’s FY 2021-22 Budget for Budget Control 060, and will be included in the budgeting process for future fiscal years.  This contract contains language allowing Sheriff to terminate the contract or reduce the level of services without penalty with cause or without cause in the event that funding is reduced and/or not available to continue funding the contract.
