RECOMMENDED ACTION(S):

SUMMARY:
Approval of the Easement Agreement with T-Mobile West Corporation allows the construction and maintenance of utility lines across O'Neill Regional Park to a wireless communications facility that will result in enhanced cell phone service for park visitors and neighboring residents.
BACKGROUND INFORMATION:
T-Mobile West Corporation (T-Mobile) has entered into a Lease Agreement with the Santa Margarita Water District (District) to construct, operate, and maintain a wireless communications facility on District property located in the City of Rancho Santa Margarita. The District property is accessed from a nearby existing subdivision of homes by a paved service road that crosses approximately 100 feet of O'Neill Regional Park. (Exhibit A: Location Map). The District has an access easement from the County for the road.
T-Mobile has requested a separate easement for a fiber optic cable line to serve its facility. The cable will be located underground and will include a small 2' by 3' equipment vault. Exhibit B is an Easement Agreement that will convey to T-Mobile a permanent easement for construction and maintenance of the fiber optic cable line. As compensation for the easement, T-Mobile will pay the County an annual fee of $2,500, increasing every five years by the Consumer Price Index. T-Mobile has also paid the County a $5,000 processing fee.
Compliance with CEQA: The subject project is Categorically Exempt from the provisions of CEQA pursuant to Section 15305 of the CEQA Guidelines (Class – Minor alteration in land use limitations).
