SUMMARY:
Award of the contract for
Pre-Construction Phase Services will provide for continued design phase and
related document development for the Adult Re-Entry Center Project, now known
as the Coordinated Re-Entry Center, which will create temporary housing, job
placement assistance, counseling and other services for adult individuals
exiting the correctional system to support their reintegration into the
community.
BACKGROUND
INFORMATION:
The Integrated Services 2025 Vision
Report (Report) was adopted by the Board of Supervisors (Board) on October 22,
2019. This plan builds on the work started by Sheriff Sandra Hutchens through
the Stepping Up Initiative, which sought to reduce unnecessary incarceration
and recidivism in Orange County. The Report links the County criminal justice
system and County Systems of Care to provide inmates and at-risk-individuals
with the services they need to become self-determined and facilitate successful
reintegration into the community. One of five Report "pillars",
Reentry, is to develop a comprehensive system to ensure continuity in treatment
for mental health and substance use disorders ultimately promoting positive
outcomes.
Youth Guidance Center (YGC) is located
at 3030 N. Hesperian Way, Santa Ana, CA 92706, and was built in 1967. Orange
County Probation Department (Probation) utilizes the YGC to provide educational
services and housing for low-risk juvenile offenders. The current YGC
population will be relocated to the new Youth Transition Center at Juvenile
Hall once completed in early 2027. The YGC site will be redeveloped by two
continuous phases transforming the facility into a new Adult Re-Entry Center,
now known as the Coordinated Re-Entry Center (Center), for adults. The Basis of
Design (BOD) Scope of Work consists of redevelopment three of five housing pods
into modern resident bedrooms, lounge and study areas, communal restroom,
laundry room, counseling room, computer lab and common living areas separating
men and women. Exterior windows, internal walls, floors, ceilings and roof will
be enhanced and reconstructed per architectural design by the OC Public Works
contracted architect Lionakis. Other improvements will include a stand-alone
new elevator structure for accessibility compliance, landscape and hardscape
enhancements. The current YGC gated entrance will be improved to accommodate a
less institutional appearance while maintaining a sense of security. Reception
entrance will be enhanced with an interconnecting first level glass lobby. The
work in Housing Pod 3 will be phased separately pending the transfer of the
current YGC population.
On January 16, 2024, OC Public
Works issued a Request for Proposal (RFP) for Pre-Construction Phase Services (Services)
the Center Project (Project). The RFP was advertised in several industry
publications and on the County online bid system. Two proposals were received
and deemed responsive. The evaluation panel composed of members from OC Public
Works, Probation and Lionakis scored the responsive proposals. See Attachment D
for the Summary of Evaluators’ Scoring. The resulting rankings are as follows:

OC Public Works solicited Services
for this Project in accordance with the 2020 Design and Construction
Procurement Policy Manual (DCPM), Section 3. The Orange County Preference
Policy was not applicable to contracts procured in accordance with the DCPM.
OC Public Works is recommending the
Board award the Contract MA-080-24010624 (Contract) to Bernards Bros. Inc.
(Contractor) for Services for the Project, for a Guaranteed Maximum Price of
$99,721, effective upon execution of all necessary signatures.
OC Public Works will return to the
Board with a proposed contract to provide construction phase services for the
Project at a later date.
The Contractor's license number was
verified as current and active through the California Contractors State License
Board database on June 7, 2024, and a copy of the verification is on file. The
Contractor is located in Los Angeles County.
OC Public Works has conducted due
diligence on the Contractor. Reference checks were satisfactory and completed
with the City of Atascadero, Los Angeles County and The Freshwater Group
regarding similar projects.
The Contract does not currently
include subcontractors or pass through to other providers. See Attachment B for
Contract Summary Form.
Compliance
with CEQA:
This action is not a project within the meaning of CEQA Guidelines Section
15378 and is therefore not subject to CEQA, since it does not have the
potential for resulting in either a direct physical change in the environment,
or a reasonably foreseeable indirect physical change in the environment. The
approval of this agenda item does not commit the County to a definite course of
action in regard to a project since it is an approval of a contract for
Services for the Project, which includes preliminary design work and generation
of documents necessary for CEQA review. This proposed activity is therefore not
subject to CEQA. Any future action connected to this approval that constitutes
a project will be reviewed for compliance with CEQA.
FINANCIAL
IMPACT:
Appropriations for the proposed
Contract are included in Fund 15D, Countywide Capital Projects, FY 2024-25
Budget.
The proposed Contract includes
provisions stating that the Contract may be terminated upon 10 days written
notice for cause and upon not less than seven calendar days' written notice for
convenience without penalty to the County.
