SUMMARY:
Approval of Amendment Five to the Small City Cooperation Agreements, Amendment Two to the Metropolitan City Cooperation Agreements and adding a small city Cooperation Agreement and a Joint Cooperation Agreement will provide a mechanism for 12 Small Cities, three Metropolitan Cities and the County of Orange to access federal funding through the Urban County Program for FY 2021-22 through FY 2023-24 for housing and community development activities.
BACKGROUND INFORMATION:
The U.S. Department of Housing and Urban Development (HUD) requires Cooperation Agreements between the County and cities electing to participate in the County of Orange Urban County Program. Urban counties are a type of entitlement community that has met certain population thresholds to qualify to receive a direct entitlement allocation of Community Development Block Grant (CDBG) funds. These funds are used for housing and community development activities for public services in the form of: homeless activities such as emergency shelter operations, community center operations and improvements; housing rehabilitation for low- to moderate-income clientele; and improvements to public facilities within the 14 participating cities and County unincorporated areas.
County of Orange cities with less than 50,000 in population (Small Cities) and cities with over 50,000 in population (Metro Cities) can elect to participate in the County of Orange Urban County Program. The County of Orange is required by HUD to renew its Urban County entitlement status every three years and can amend its existing Cooperation Agreements with eligible participating cities to extend the term without having to enter into new Agreements.

This is Amendment Two to the Metro City Cooperation Agreements as those cities did not join the Urban County Program until FY 2015-16 and Amendment Five to the Small Cities Cooperation Agreements.
HUD sent the final instructions for Urban County qualification on March 9, 2020. As required by HUD, on April 17, 2020, the County notified each Small City and Metro City of its right to elect to be included or excluded from the FY 2021-22 through FY 2023-24 County of Orange Urban County Program.
As of the finalization of this Agenda Staff Report, the following Cities have elected to participate in the Urban County Program for FY 2021-22 through FY 2023-24.

To continue to qualify as an Urban County, the Cooperation Agreements are required to be submitted to HUD by August 16, 2020.
Approval of Amendment Five to the Small City Cooperation Agreements, Amendment Two to the Metro City Cooperation Agreements and adding a Small City Cooperation Agreement and a Joint Cooperation Agreement will provide federal funding through the Urban County Program for FY 2021-22 through FY 2023-24 for housing and community development activities that will support the ongoing operations of program and services that are part of the Orange County System of Care, including addressing the needs of those experiencing homelessness in Orange County.
Compliance with CEQA: The proposed activity is not a project as defined under CEQA Section 15378 (b)(4) of the California Environmental Quality Act Guidelines.
Compliance with NEPA: The proposed activity is Exempt from National Environmental Policy Act per 24 CFR 58.34 (a)(3).
