RECOMMENDED
ACTION(S):
Authorize the
Director of OC Public Works or designee to execute a contract for the Orange
County Local Road Safety Plan with Fehr & Peers, for a five-year term
effective upon Board of Supervisors approval, in an amount not to exceed
$749,826.
SUMMARY:
Approval of a
contract to develop the Orange County Local Road Safety Plan will establish a
proactive framework for identifying, analyzing and prioritizing roadway safety
improvement projects within unincorporated Orange County.
BACKGROUND
INFORMATION:
OC Public Works
requires supplemental Architect-Engineer (A-E) Services to develop the Orange
County Local Road Safety Plan (LRSP) (Services). The LRSP builds upon the
County of Orange’s (County) efforts to significantly reduce and eliminate
roadway fatalities and serious injuries within the County’s roadway network.
The LRSP will be a comprehensive safety action plan that centers around Vision
Zero principles, integrates a safe systems approach, coordinates existing
efforts, evaluates existing conditions, establishes traffic collision trends,
incorporates engagement with a focus to underserved communities, identifies
mitigation strategies and develops prioritized project recommendations. The
process of developing an LRSP results in a prioritized list of issues, risks,
actions and improvements catered towards reducing fatalities and serious
injuries. This systematic process when developing the LRSP not only considers
engineering, but also the other “E’s” such as equity, engagement,
education/encouragement and evaluation, allowing the County to be proactive in
its efforts to increase roadway safety.
On August 23, 2022, the Board of
Supervisors (Board) approved the application for the Safe Streets and Roads for
All (SS4A) Grant Program, sponsored by United States Department of
Transportation Infrastructure Investment and Jobs Act. On February 28, 2023,
the Board accepted $808,000 in grant funds, with a local match of $202,000.
On December 13, 2023, OC Public Works
issued a Request for Proposals (RFP) for Services for the preparation of an
LRSP. The RFP was advertised on the County online bidding system. Three
proposals were received and deemed responsive. An evaluation committee composed
of five representatives from OC Public Works completed its evaluation process
and provided its recommendation. Based on the criteria set forth in the RFP, OC
Public Works is recommending award of a contract to develop the LRSP to Fehr
& Peers. A summary of the rankings is attached as part of the Summary of
Evaluators’ Scoring (Attachment D).
OC Public Works is procuring these
Services in accordance with the 2020 Design and Construction Procurement Policy
Manual (DCPM), Section 3.3-102(1). The Orange County Preference Policy is not
applicable to contracts procured in accordance with the DCPM.
OC Public Works is recommending Board
approval of Contract MA-080-24010355 (Contract) with Fehr & Peers
(Contractor) for Services, for a five-year term effective upon Board approval,
in an amount not to exceed $749,826. The five-year term is governed by the SS4A
Grant Program; however, we anticipate that the Contractor will complete the
work in FY 2026-27.
The Contract scope
is defined by eight major tasks. Tasks one through six, which include data
gathering and analysis, public/stakeholder engagement and strategy and project
recommendations, are anticipated to be completed in the first eighteen months
of the Contract term. The remaining tasks seven through eight, which
include progress reporting and full development of the Safety Action Plan are
anticipated to be completed in FY 2026-27.
The Contractor’s license number was
verified as current and active through the Department of Consumer Affairs
database on January 18, 2024. A copy of the verification is on file.
OC Public Works has conducted due
diligence on the Contractor. Reference checks were satisfactory and completed
with City of Irvine, City of Lake Elsinore and San Bernardino County regarding
similar services. The Contractor is based in Contra Costa County with a local
office in Orange County.
The Contract includes subcontractors. See
Attachment B for information regarding subcontractors and the Contract Summary
Form.
Compliance
with CEQA:
This action is not a project within the meaning of CEQA Guidelines Section
15378 and is therefore not subject to CEQA since it does not have the potential
for resulting in either a direct physical change in the environment or a
reasonably foreseeable indirect physical change in the environment. The
approval of this agenda item does not commit the County to a definite course of
action in regard to a project since it involves approval of a Contract for
Services to develop the LRSP. This proposed activity is therefore not subject
to CEQA. Any future action connected to this approval that constitutes a
project will be reviewed for compliance with CEQA.
FINANCIAL IMPACT:
Appropriations for
the Contract are included in Fund 115, OC Road, FY 2024-25 Budget and will be
included in the budgeting process for future years.
The Contract includes a provision stating
the Contract is subject to, and contingent upon, applicable budgetary appropriations
approved by the Board for each fiscal year during the term of the Contract. If
such appropriations are not approved, the Contract may be immediately
terminated without penalty to the County.
