RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or Deputized designee to execute Amendment No. 1 to extend the contract with ChargePoint, Inc. for Network Electric Vehicle Charging Stations, Service and Maintenance, by three years, such that the term ends on August 26, 2027, with no cost increase for a cumulative total amount not to exceed $1,368,522.

 

 

 

 

SUMMARY:

 

Approval of Amendment No. 1 to extend the contract for Network Electric Vehicle Charging Stations, Service and Maintenance will allow OC Public Works to provide services necessary for use by County of Orange owned electric vehicles, employees and the public.

 

 

BACKGROUND INFORMATION:

 

There are approximately 2.9 million vehicles registered in Orange County of which approximately 4 percent (116,000) are Electric Vehicles (EVs). The number of EVs is expected to increase due in part to the California Air resources Board (CARB) Advanced Clean Cars (ACC) legislation.      

 

Advanced Clean Cars II (ACC II) regulations were adopted in 2022, imposing the next level of low-emission and zero-emission vehicle standards for vehicle model years 2026-2035 that contribute to meeting federal ambient air quality ozone standards and California’s carbon neutrality targets. ACC II requires that all new passenger cars, trucks and sport utility vehicles (SUV) sold in California will be zero emissions by 2035. The ACC II regulations will rapidly scale down light-duty passenger car, pickup truck and SUV emissions starting with the 2026 model year through 2035. The number of EVs will continue to grow requiring a concurrent growth in the number of EV chargers.

 

On May 29, 2019, OC Public Works issued a Request for Proposals (RFP) for Network Electric Vehicle Charging Stations (EVCS) Service and Maintenance (Services). Prior Board of Supervisors (Board) action is summarized in the table below.

This Contract’s five-year term includes networking and maintenance for up to 43 County-owned ChargePoint EVCS through August 26, 2024. Sixteen EVCS are located in public parking areas and are available for public use. The ChargePoint EVCS currently require the proprietary networking and maintenance provided by the Contractor. If the County were to change networking and maintenance providers, OC Public Works would have to concurrently replace the ChargePoint EVCS, which have not reached the end of useful life.

 
OC Public Works’ plan is to continue to design and install additional EVCS pending available funding and Contract capacity and will monitor the life cycle of the existing EVCS and evolution of charging technology and hardware over the next two years to determine the best time to competitively advertise for subsequent phases of the County’s EVCS program.

 

OC Public Works is proposing to continue procuring these Services in accordance with the 2021 Contract Policy Manual Section 3.3-102. The Orange County Preference Policy was not applicable for this solicitation.

OC Public Works is recommending Board approval to authorize the County Procurement Officer or Deputized designee to execute Amendment No. 1 to extend the Contract with the Contractor for Services, for three years, such that the term ends on August 26, 2027, with no cost increase for a cumulative total amount not to exceed $1,368,522. The Contractor is based in Santa Clara County.

 

The Contractor’s performance has been confirmed as at least satisfactory. OC Public Works has verified there are no concerns that must be addressed with respect to Contractor’s ownership/name, litigation status or conflicts with County interests.

 

This Contract does not currently include subcontractors or pass through to other providers. See Attachment C for information regarding subcontractors and Contract Summary Form.

 

Prior to contract expiration, OC Public Works plans to issue a solicitation to continue Services.

 

Compliance with CEQA: The proposed project was previously determined to be Categorically Exempt from CEQA pursuant to Section 15301 (Class 1) of the CEQA Guidelines, on August 27, 2019, when it was originally approved because it involves approval of a Contract for Services to existing public facilities (County parking garages), involving negligible or no expansion of existing use. The proposed project is still consistent with this determination.

 

 

 

FINANCIAL IMPACT:

 

There is no financial impact associated with the Recommended Actions of this Agenda Staff Report.

 

Appropriations for this Contract are included in Fund 137, Parking Facilities, FY 2024-25 Budget and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
