RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute sole source contract with Air Bear Tactical Aircraft LLC for the one-time purchase of Mahindra Aerospace Airvan-8 Task Force Fixed Wing Aircraft, effective upon Board of Supervisors approval, in an amount not to exceed $3,646,360.21.

 

 

 

SUMMARY:

 

Approval of sole source contract with Air Bear Tactical Aircraft LLC will allow the Sheriff-Coroner Department to purchase one Mahindra Aerospace Airvan-8 Task Force Fixed Wing Aircraft which will increase the safety and abilities of the Sheriff-Coroner Department's Regional Narcotics Suppression Program to perform its mission effectively.

 

 

BACKGROUND INFORMATION:

 

The Sheriff-Coroner Department (Sheriff) Orange County Regional Narcotics Suppression Program (RNSP) is a major narcotics task force, whose primary mission is to target, investigate and prosecute individuals who organize, direct, finance or otherwise engage in high-level drug trafficking or money laundering organizations. In addition to the Sheriff’s Department, the RNSP is comprised of eight other local law enforcement agencies, one state and three federal agencies throughout Orange County, to include the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), and the Army National Guard.  Since its inception in 1986, RNSP has seized more than 20,000 pounds of methamphetamine, 47,000 kilograms of cocaine, 1,100 pounds of heroin, 178,000 pounds of marijuana, and made over 2400 arrests.  A large part of RNSP’s success lies in its ability to force multiply by effectively surveilling these drug trafficking organizations with the assistance of aerial support.  Without the advantage of aerial support, surveillance of these drug trafficking organizations would be extremely difficult with an increased likelihood of surveillance officers being exposed.

Sheriff is requesting the approval of a sole source contract from Air Bear Tactical Aircraft LLC for the purchase of a new airplane with intelligence, surveillance, and reconnaissance (ISR) equipment in order to replace an aging airplane and outdated equipment.  For officer safety reasons, it is necessary to replace the current Cessna 182, which is 37 years old with a new Mahindra Aerospace Airvan 8 from Air Bear Tactical Aircraft LLC.  This new aircraft will comply with the current safety standards required by the Federal Aviation Administration and have the ability to carry the ISR equipment that will bring RNSP in line with industry standards.  RNSP’s current ISR equipment consists of a handheld set of gyro-stabilized binoculars and a Garmin automobile GPS.  The new ISR equipment would include a high definition long range camera system with infrared technology providing aerial surveillance with night vision capabilities for the first time in RNSP history.  Included in the ISR equipment is an aerial mapping system that integrates with the camera and overlays streets on the camera image.  This will transfer some of the workload from the pilot to the tactical flight officer, thereby allowing the pilot to focus more on the safety of the flight.  The purchase of the new airplane and equipment will increase the safety and abilities of RNSP to perform its mission effectively.

Air Bear Tactical Aircraft LLC is the only company that can provide the Mahindra Aerospace Airvan-8 Task Force Fixed Wing Aircraft with the needed ISR equipment.  The proposed contract is a sole source contract, and a completed Sole Source Request Form is attached to this Agenda Staff Report (Attachment B).

 

The Sheriff requests approval of the proposed Air Bear Tactical Aircraft LLC contract for the one-time purchase of one Mahindra Aerospace Airvan-8 Task Force Fixed Wing Aircraft, effective upon Board of Supervisors approval, in the amount of $3,646,360.21. This contract does not include subcontractors or pass through to other providers.  See Attachment C for the Contract Summary Form.

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff-Coroner’s FY 2017-18 Budget for Fund 118, Regional Narcotics Suppression Program – Department of Justice, and will be included in FY 2018-19 Budget.  The purchase and operation of this aircraft is 100% funded through Department of Justice programs.  This contract contains language allowing the Sheriff-Coroner Department to terminate the contract or reduce the level of services without penalty with cause or without cause in the event that funding is reduced and/or not available to continue funding the contract.
