issuance of the Notice to Proceed, in an amount not to exceed $1,989,116. |

SUMMARY:
Approval of the
contract with SWT Engineering, Inc. for Zone 4 Phase B Groundwater Composite
Liner Project Design for the Prima Deshecha Landfill will support continued
landfill operations and maintain compliance with state and federal regulations.
BACKGROUND
INFORMATION:
OC Waste &
Recycling (OCWR) is responsible for managing the County of Orange (County)
solid waste disposal system, including South Region Landfills that consist of
the active Prima Deshecha Landfill (Prima) and five closed solid waste disposal
sites. Prima was opened in 1976 to meet the solid waste disposal needs of the
southern portion of Orange County. Prima is a 1,530-acre landfill site located
within unincorporated Orange County and the cities of San Juan Capistrano and
San Clemente. Development of Zone 4 provides needed disposal capacity for Prima
through the anticipated closure date in 2102, ensures long term disposal
capacity for the County and supports the stable rate structure for the cities
and special districts within the County for future generations.
Zone 4 Phase B
Groundwater Composite Liner Project Design for the Prima Deshecha Landfill
(Project) is for the design of approximately a 50-acre in Prima Zone 4. The
design will be for grading, protective liner, road and facility improvements, installation
of systems for leachate collection, landfill gas collection and facility
drainage control. OCWR does not have sufficient in-house resources nor the
expertise to perform the required hydrology and drainage design, design report
and improvement plans preparation, coordination with regulatory agencies, bid
support and construction engineering support services. Therefore, it is
necessary to contract out the specialized design services (Services) to support
landfill infrastructure expansion projects.
Approval
of the contract with SWT Engineering, Inc. for Zone 4 Phase B Groundwater
Composite Liner Project Design for the Prima will support continued landfill
operations and maintain compliance with state and federal regulations.
On
January 10, 2023, the Board approved the establishment of a Qualified Vendors
List (QVL) for Landfill Services. SWT Engineering, Inc. (SWT) is included as a
qualified contractor on this QVL.
The
Services have been procured in accordance with the 2020 Design and Construction
Policy Manual, Section 3.3. The Orange County Preference Policy is not
applicable to this contract.
The
contractor's performance has been confirmed as at least satisfactory. OC Waste
& Recycling verified there are no concerns that must be addressed with
respect to the contractor's ownership/name, litigation status or conflicts with
County interests.
This
contract includes subcontractors. See Attachment B for information regarding
subcontractors and Contract Summary Form
Compliance
with CEQA: This
action is not a project within the meaning of CEQA Guidelines Section 15378 and
is therefore not subject to CEQA, since it does not have the potential for
resulting in either a direct physical change in the environment, or a reasonably
foreseeable indirect physical change in the environment. The approval of this
agenda item does not commit the County to a definite course of action in regard
to a project since the activity is the awarding of a contract for Services
only. This proposed activity is therefore not subject to CEQA. Any future
action connected to this approval that constitutes a project will be reviewed
for compliance with CEQA.
FINANCIAL IMPACT:
Appropriations
for this contract are included in the FY 2023-24 Budget for OCWR Capital
Project Fund 273, and will be included in the budgeting process for future
years.
The proposed
contract includes a provision stating the contract is subject to, and
contingent upon, applicable budgetary appropriations approved by the Board for
each fiscal year during the term of the contract. If such appropriations are
not approved, the contract may be immediately terminated without penalty to the
County.
