RECOMMENDED ACTION(S):

 

 

1.

Approve the Fifth Amendment to the Agreement with the Orange County Transportation Authority for law enforcement services, for the term of July 1, 2024, through June 30, 2025.

 

2.

 

 

Approve the FY 2024-25 charges for law enforcement services to the Orange County Transportation Authority for the term of July 1, 2024, through June 30, 2025, in an amount not to exceed $12,211,479, for a revised cumulative contract total amount of $54,438,960.

 

3.

Approve $447,957 as the total amount for special and supplemental services, including canine explosive detection services, for the term of July 1, 2024, through June 30, 2025.

 

 

 

 

 

SUMMARY:

 

Approval of the Fifth Amendment to the Agreement with the Orange County Transportation Authority will allow the Sheriff-Coroner Department to continue to provide law enforcement services for the Orange County Transportation Authority, including canine explosive detection services.

 

 

 

BACKGROUND INFORMATION:

 

Orange County Transportation Authority (OCTA) has been contracting with the County for the Sheriff-Coroner Department (Sheriff) to provide law enforcement services since March 1993.  The table below notes when the Board of Supervisors (Board) approved the most recent agreements, amendments and any annual adjustment amount.

Sheriff requests Board approval of the Fifth Amendment to the Law Enforcement Agreement for the term of July 1, 2024, through June 30, 2025, as noted in the Recommended Actions. 

 

Proposed law enforcement services for FY 2024-25 include the following positions and service levels as noted on the table below:

The total cost to OCTA for the contracted law enforcement services is $12,211,479.  In addition, pursuant to the agreement, OCTA may request additional special and supplemental services, such as use of the Mounted Enforcement Unit to patrol environmental mitigation properties owned by OCTA, canine explosive detection services and seasonal law enforcement services and special enforcement activities, up to a maximum cost of $447,957, for a firm, fixed total cost of $12,659,436.

 

Agreement costs include salaries, wages, benefits, services and supplies and transportation expenses as well as division, department, and County-Wide Cost Allocation Plan overhead. FY 2024-25 contract service costs are 7.42 percent higher ($874,461) than the current fiscal year's fourth amendment to the agreement of $11,784,785. The increase is due to salary and benefit increases to labor agreements.    

 

The $447,957 authorized amount for special and supplemental services is established annually by OCTA based on projected service need and available funding.

 

This agreement is submitted for approval less than 30 days prior to the start of the proposed agreement due to an extended negotiation period over the terms and conditions in the agreement, and the need to have OCTA approval before presenting the agreement to the Board for approval. The OCTA Board of Directors agendized this agreement for approval at its June 11, 2024, meeting. 

 

 

 

FINANCIAL IMPACT:

 

Orange County Transportation Authority is responsible for 100 percent of the costs related to this agreement. Appropriations and Revenue for this agreement are included in Budget Control 060, Sheriff-Coroner FY 2024-25 Budget. Adjustments to reconcile positions with related appropriations and revenue to the adopted FY 2024-25 agreement will be requested in the FY 2024-25 Mid-Year Budget Report.
