RECOMMENDED
ACTION(S):

Approve and authorize execution of the
State of California Agreement SA-080-24FT between the State of California's
32nd District Agricultural Association and the
County of Orange for the Sheriff-Coroner to provide law enforcement services
for the 2024 Orange County Fair, for the period of July 14, 2024, through
August 20, 2024, with a maximum obligation of $1,035,000. |

SUMMARY:
Approval of the
agreements between the State of California and the County of Orange will allow
the Sheriff-Coroner Department to provide law enforcement services at the 2024
Orange County Fair.
BACKGROUND
INFORMATION:
The 32nd District
Agricultural Association of the State of California has been contracting with
the County since 1982 for the Sheriff-Coroner Department (Sheriff) to provide
law enforcement services at the Orange County Fairgrounds during the annual
Orange County Fair.
The following
table details the recent agreement history with the Orange County Fairgrounds
for law enforcement services for the Orange County Fair.

The proposed
agreement includes a mutual indemnification provision. The non-standard
indemnification provisions used by the State of California (State) were
reviewed and approved by CEO-Office of Risk Management, as both public entities
are both highly self-insured. The County Agreement also authorizes Sheriff to
enforce the City of Costa Mesa (City) Municipal Code during the term of the
Agreement. CEO-Office of Risk Management has reviewed and approved the non-standard
language, as acceptable for Sheriff to provide security since the Orange County
Fair is held on State property. A Risk Assessment of Insurance Terms Form is
attached (Attachment C).
The rates to provide law enforcement services at the Orange County Fair are
determined by Sheriff and include salaries and wages, benefits, services and
supplies and indirect costs, which include County-Wide Cost Allocation Plan,
division and department overheads. Costs are 100 percent reimbursed by the
State.
A pre-planning meeting is held annually
with representatives of the State’s 32nd District Agricultural Association during which
Sheriff recommends the level of service required and to establish the maximum
obligation for State budgetary purposes. For the 2024 Orange County Fair, the
maximum obligation is $1,035,000. The increase is due to OC Fair requesting
additional staff.
This agreement is submitted for approval
less than 30 days prior to the start of the proposed agreement due to an
extended negotiation period over the terms and conditions in the agreement, and
the need to have the County Fair and Events Center Board approval before
presenting the agreement to the Board for approval. The Orange County Fair and
Events Center Board approved the budget for the 2024 Orange County Fair at its
April 25, 2024, public hearing.
FINANCIAL IMPACT:
Appropriations and
revenue for this agreement will be included in the Sheriff-Coroner's FY 2024-25
Budget for Budget Control 060, based on 2024 actual amounts. There will be no
cost to the County for providing these services because the State will fully
reimburse the County.
