SUMMARY:
Approval of Amendment No. 5 to
extend the Cooperative Agreement for Water Quality Program Support provides for
continuing operation of the University of California Cooperative Extension
within Orange County for community education and environmental protection.
BACKGROUND
INFORMATION:
Since 1990, the County of Orange
(County) has provided funding to the Regents of the University of California
(Regents) to maintain a Cooperative Extension (CE) office within Orange County.
Baseline funding of $125,000 per year was provided to sustain the CE office and
provide residents and businesses of Orange County with the latest scientific
information in agriculture, gardening and nursery production.
Beginning in 2004, OC Public Works
required services to comply with water quality mandates, including water
quality research, education and outreach activities. By virtue of its core
programs and existing staffing, University of California Cooperative Extension
(UCCE) had specialized expertise, especially in areas related to fertilizer and
pesticide applications.
Prior Board of Supervisors (Board)
actions related to Cooperative Agreement D04-060 (Agreement) for Water Quality
Program Support for UCCE to provide research, education and outreach on
fertilizer and pesticide applications, exotic species control, education,
outreach and training for pesticide management to meet regulatory compliance
are summarized in the table below.

The annual funding model of
$250,000 to support the UCCE’s core and water resources programming has changed
since the inception of the agreement with the Regents in 2005. This amount no
longer covered the core expenses for UCCE’s operations in Orange County,
including office space, vehicle mileage charges and some research and extension
support staffing costs that have increased significantly since 2005. Appropriately,
Amendment No. 4 to the Agreement included an increase of $50,000 in year three,
which commenced on July 1, 2022, to bring the total annual payment thereafter
to $300,000 per year. The increased core funding indirectly supports UCCE’s
efforts to add additional office and lab space for grant-funded work to address
emerging issues, such as new invasive pests and green waste reduction research,
by allowing it to redirect internal resources to these programs.
OC Public Works recommends the
Board approve Amendment No. 5 with the UCCE to extend the term for one year,
effective July 1, 2025, through June 30, 2026, in the annual amount of $300,000
for a cumulative total amount of $5,150,300, and delegate authority to the
Director of OC Public Works or designee to extend the Agreement for four
additional one-year terms through June 30, 2030, in the annual amount of
$300,000.
Compliance
with CEQA:
The proposed project was previously determined to be Categorically Exempt from
the California Environmental Quality Act (CEQA) pursuant to Section 15322
(Class 22) of the CEQA Guidelines on February 10, 2015, because it consists of
an amendment to an Agreement for water quality program support that continues
the operation of an educational program involving no physical alteration in the
area affected. The proposed project is still consistent with this
determination.
FINANCIAL
IMPACT:
Appropriations for Amendment No. 5
to the Agreement will be included in the FY 2025-26 Budget for Fund 400, OC
Flood, and will be included in the budgeting process for future years.
Existing terms in the Agreement
allow the County to terminate the Agreement for any reason if it determines the
UCCE's services are no longer needed. The terms further stipulate that the
funding obligation of the County is subject to the availability of funds
appropriated for this purpose in any given fiscal year. UCCE is aware that
funding or portions of funding are contingent on sufficient appropriations for
the services of this Agreement in the budget approved by the Board.
