RECOMMENDED
ACTION(S):
Authorize the Director of OC Public
Works or designee to execute a contract with GHD Inc. for design services for
the Capistrano Beach Nature-Based Shoreline Adaptation Project, for a five-year
term effective upon execution of all necessary signatures, in an amount not to
exceed $706,733.
SUMMARY:
Award of contract will provide
design and permitting services for the Capistrano Beach Nature-Based Shoreline
Adaptation Project, which will strengthen public beach resiliency and safeguard
shoreline and infrastructure assets from coastal erosion.
BACKGROUND
INFORMATION:
OC Community Resources/OC Parks
(OCCR/OC Parks) manages several coastal facilities, including Capistrano Beach
in the City of Dana Point. This shoreline features a narrow, sandy beach mixed with
cobble. To the north, Doheny State Beach, a California Department of Parks and
Recreation (DPR) facility shares the same narrow shoreline characteristics.
Both beaches are bordered by a passenger rail line and Coast Highway to the
east, with shoreline-developed properties to the south and coastal bluff-backed
development further inland.
For many years, these beaches have
faced coastal erosion due to limited sediment supply, storm waves and high
tides, leading to the loss of recreational facilities and increased
vulnerability to flooding. While mitigation efforts, such as geotextile sand
cubes, rip-rap and sand nourishment, have provided temporary relief, erosion
continues to threaten the shoreline.
The Capistrano Beach Nature-Based
Shoreline Adaptation Project (Project) has been proposed as a joint effort with
DPR to reduce the impacts of coastal erosion. The Project involves the
construction of a buried cobble berm system with vegetated sand dunes along
1,150 feet of shoreline. In addition to stabilizing the shoreline, the Project
will help protect infrastructure, enhance the ecosystem and preserve
recreational and economic value.
On June 4, 2024, the Board of
Supervisors (Board) authorized OCCR/OC Parks to accept a grant under the
Federal Emergency Management Agency (FEMA) Building Resilient Infrastructure
and Communities (BRIC) Program in an amount of $422,700 to support Phase I –
Design and Permitting of the Project. On April 15, 2025, OC Public Works
received confirmation from California Governor's Office of Emergency Services
(Cal OES) that grant funding for Phase I (design phase) is secured despite
FEMA’s announcement that the BRIC program will be discontinued. The Project can
move forward with design phase and FEMA will complete a program review to
confirm the recommendation for Phase II construction funds or OCCR/OC Parks can
apply for funding under a different program.
On June 25, 2024, the Board
authorized OCCR/OC Parks to accept a grant award under the California Ocean
Protection Council’s Senate Bill 1 grant program, in an amount of $220,000 to
contribute to the Project.
Under the County of Orange (County)
Contract Policy Manual (CPM), federally funded service contracts must follow
applicable federal regulations for procurement. Procurement transactions under
a federal award must ensure full and open competition.
On January 21, 2025, OC Public
Works issued a Request for Proposals (RFP) for Design Phase Services for Phase
I (Services) on the County online bidding system. Three bids were received; two
were deemed responsive and one was deemed non-responsive. On February 21, 2025,
an evaluation panel composed of OCCR/OC Parks, OC Public Works and DPR staff
completed the written evaluation of the responsive proposals. On March 3, 2025,
the evaluation panel completed the interview evaluation process and provided
its recommendations. Based on the criteria set forth in the RFP, OC Public
Works is recommending a contract be awarded to GHD Inc. (Contractor), for the
Services. A summary of the ranking is attached as part of the Memorandum of
Recommendation (Attachment C) and the Summary of Evaluator Scoring (Attachment
D).
OC Public Works is procuring these
Services in accordance with the 2024 CPM Section 3.4. The Orange County
Preference Policy was not applicable.
OC Public Works is recommending the
Board approve Contract MA-012-25010139 (Contract) with the Contractor for
Services effective upon execution of all necessary signatures for five years,
in an amount not to exceed $706,733.
OC Public Works has conducted due
diligence on the Contractor. All professional Engineering licenses were
verified in the Department of Consumer Affairs Database on March 17, 2025.
Reference checks were satisfactory and completed with the City of Encinitas,
San Mateo Harbor District and City of Oceanside regarding similar projects or
services. The Contractor is located in Orange County. An analysis was completed
to determine the Contract provides the County with persons specially trained,
experienced, expert and competent to perform the special services in accordance
with the law.
This Contract includes
subcontractors. See Attachment B for the Contract Summary Form.
Compliance
with CEQA:
This action is not a project within the meaning of CEQA Guidelines Section
15378 and is therefore not subject to CEQA, since it does not have the
potential for resulting in either a direct physical change in the environment,
or a reasonably foreseeable indirect physical change in the environment. The
approval of this agenda item does not commit the County to a definite course of
action in regard to a project since it’s an approval of a contract for the
Design Phase Services to provide comprehensive architectural, engineering,
environmental, regulatory permitting, and construction support services for the
proposed Project. This proposed activity is therefore not subject to CEQA. Any
future action connected to this approval that constitutes a project will be
reviewed for compliance with CEQA.
FINANCIAL
IMPACT:
Appropriations for this Contract
are included in Fund 406, OC Parks Capital, FY 2024-25 Budget and will be
included in the budgeting process for future years.
The proposed Contract includes a provision
stating the Contract is subject to, and contingent upon, applicable budgetary
appropriations approved by the Board for each fiscal year during the term of
this Contract. If such appropriations are not approved, this Contract may be
immediately terminated without penalty to the County.
