RECOMMENDED ACTION(S):

 

Authorize the County Purchasing Agent or authorized Deputy to renew and amend the Contract with Golden State Constructors for Portland Cement Concrete Maintenance and Repair Services in an annual amount not-to-exceed $245,000, commencing on June 17, 2017, through June 16, 2019, for a revised cumulative Contract total amount not-to-exceed $1,225,000.

 

 

 

SUMMARY:

 

Approval to renew and amend the Contract with Golden State Constructors for Portland Cement Concrete Maintenance and Repair Services will support maintenance and repair of access ramps, curbs, gutters and sidewalks in the unincorporated areas of Orange County and within contract cities.

 

 

 

BACKGROUND INFORMATION:

 

OC Public Works requires the use of construction contractors to supplement OC Public Works staff in concrete repair operations. The use of contracted services allows for timely repair or replacement of deteriorated sidewalks, curbs, gutters, access ramps and other road related concrete structures.

 

On June 17, 2014, the Board of Supervisors (Board) approved Contract MA-080-14011541 (Contract) with Golden State Constructors (Contractor) for Portland Cement Concrete Maintenance and Repair Services in an amount not-to-exceed $245,000 for a one-year period, effective June 17, 2014, through June 16, 2015, renewable for four additional one-year periods. This Contract was awarded as a result of an Invitation for Bid.

 

On March 4, 2015, the County Deputy Purchasing Agent administratively renewed the Contract in an amount not-to-exceed $245,000 for a period of one year, effective June 17, 2015, through June 16, 2016.

 

On March 23, 2016, the Contractor sent the County a letter requesting an increase on line item pricing by 15%, citing an increase in labor, raw materials and disposal costs. After further review, the increased costs were deemed reasonable, did not impact the annual not-to-exceed amount of $245,000 and were still competitive with market pricing.

 

On May 10, 2016, the Board approved the renewal of the Contract and pricing in the amount not-to-exceed $245,000 for a period of one year, effective June 17, 2016, through June 16, 2017.

 

The Contractor has successfully performed the obligations in the most recent Contract period. Therefore, OC Public Works is requesting authorization to renew the Contract with Golden State Constructors, effective June 17, 2017, through June 16, 2019, in an annual amount not-to-exceed $245,000, for a revised cumulative contract total amount not-to-exceed $1,225,000.  Prior to contract expiration, OC Public Works plans to issue a solicitation to continue utilization of these services.

 

The Contract does not include subcontractors or pass through to other providers. See Attachment C for Contract Summary Form.

 

In accordance with Section 3.3-106 of the County’s Contract Policy Manual, all service contract renewals that exceed $100,000 per annum must be approved by the Board.

 

Compliance with CEQA: The subject project was previously determined by the Board of Supervisors to be Categorically Exempt from the provisions of CEQA pursuant to Section 15301, Class 1 at the time the Contract was approved on June 17, 2014, and again on May 10, 2016, when renewed, since it involved an agreement to support maintenance and repair of existing public access ramps, curbs, gutters and sidewalks in the unincorporated areas of Orange County and contract cities.

 

 

 

FINANCIAL IMPACT:

 

Appropriations and revenue for the Contract are included in the FY 2016-17 Modified Budget for OC Road Fund 115 and the FY 2017-18 Recommended Budget. Appropriations will be included in the budgeting process for future years.

 

The Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
